NY Times Bombshell: Trump May Not Have Owed Any Federal Tax For 18 Years Due To Business Failures

Whopper of a scoop from the New York Times:

Donald J. Trump declared a $916 million loss on his 1995 income tax returns, a tax deduction so substantial it could have allowed him to legally avoid paying any federal income taxes for up to 18 years, records obtained by The New York Times show.

The 1995 tax records, never before disclosed, reveal the extraordinary tax benefits that Mr. Trump, the Republican presidential nominee, derived from the financial wreckage he left behind in the early 1990s through mismanagement of three Atlantic City casinos, his ill-fated foray into the airline business and his ill-timed purchase of the Plaza Hotel in Manhattan.

Tax experts hired by The Times to analyze Mr. Trump’s 1995 records said tax rules that are especially advantageous to wealthy filers would have allowed Mr. Trump to use his $916 million loss to cancel out an equivalent amount of taxable income over an 18-year period.

Although Mr. Trump’s taxable income in subsequent years is as yet unknown, a $916 million loss in 1995 would have been large enough to wipe out more than $50 million a year in taxable income over 18 years.

The $916 million loss certainly could have eliminated any federal income taxes Mr. Trump otherwise would have owed on the $50,000 to $100,000 he was paid for each episode of “The Apprentice,” or the roughly $45 million he was paid between 1995 and 2009 when he was chairman or chief executive of the publicly traded company he created to assume ownership of his troubled Atlantic City casinos.

Ordinary investors in the new company, meanwhile, saw the value of their shares plunge to 17 cents from $35.50, while scores of contractors went unpaid for work on Mr. Trump’s casinos and casino bondholders received pennies on the dollar.

        In terms of purchasing power, the overall net loss is still considerable despite not having to pay federal taxes on the $916M that were recovered in the subsequent years. Again in terms of purchasing power, potential tax liability would exist on up to $664M. Given this, I don’t see how any of what Trump did is “smart.”

            I couldn’t say. The bankruptcies were never personal, were they? I’m pretty sure not. IF what you say is true, this loss is above and beyond any bankruptcies.

            Also, I assume the $960M isn’t the only loss in those 18 yrs since 1995, since 18 takes up to 2013 and I would imagine Trump lost money in 2008 and 2009 (like everyone else did).

            You are correct that Donald has filed Chapter 11 and has never filed a personal bankruptcy which would be Chapter 13 or Chapter 7. Of course, Chapter 11 was designed to allow businessmen to file a bankruptcy for the business they were running so they do not have to file a personal bankruptcy. In all four cases the reason for the bankruptcy was the same, Donald borrowed way too much money at way too high an interest rate which means he could not service the debt based upon the income of the business. Filing a Chapter 11 allowed Donald to do several things. First he could renege on all the contracts he had ongoing or had defaulted on for services rendered in the construction and operation of the business. Secondly he was able to “cram down” the debt owned to the creditors who held secured notes on the building. This essentially means that say if he owed 5 billion in total debt liability for financing of the construction of the physical structure of the business [say the casino and hotel in Atlantic City and the value of the business property was only 500 million dollars then the creditors would find their note “crammed down” to the market value of the structure which secured the note. So say he had secured mortgages on the property for the amount of 400 million and with interest payments over the term of the mortgages this comes out to 5 billion, [and some of those projects had an 11% interest rate at the time which tells you how low his credit rating was with banks and lending institutions which finance projects like his.] the most those creditors can get is the actual sales value of the property i.e. 500 million dollars.

            Now in his personal life, Donald did almost have to file bankruptcy one time. In 1990, due to excessive leveraging, The Trump Organization revealed
            that it was $5 billion in debt ($8.8 billion by some estimates), with $1
            billion personally guaranteed by Trump himself. The survival of the
            company was made possible only by a bailout pact agreed upon in August
            of that same year by some 70 banks, allowing Trump to defer on nearly $1
            billion in debt, as well as to take out second and third mortgages on
            almost all of his properties. He essentially owed money out the ying yang after getting repeated mortgages on his personal property and using that to pour into his businesses which were failing. At one point he admits he owed over 30 million dollar personally to one bank and more to several other banks and inverstors. This meant the guys who were holding the second and third mortgages on his personal real estate assets were seriously fucked. As Trump said at the time using a version of an old business banking saying, “If you owe the bank one hundred thousand dollars, then the bank owns you.
            If you owe the bank one hundred million, then you own the bank.” So a Saudi prince he owed some of the money to as well as his other creditors arranged a bailout of his personal debt so there would not be a bankruptcy and they would not lose their shirt.

If the NOL belonged to a regular (C) corporation, that corporation would use the carry forward. If a partnership or S corporation, the partners or shareholders would use the NOL.

    The documents consisted of three pages from what appeared to be Mr. Trump’s 1995 tax returns. The pages were mailed last month to Susanne Craig, a reporter at The Times who has written about Mr. Trump’s finances. The documents were the first page of a New York State resident income tax return, the first page of a New Jersey nonresident tax return and the first page of a Connecticut nonresident tax return. Each page bore the names and Social Security numbers of Mr. Trump and Marla Maples, his wife at the time. Only the New Jersey form had what appeared to be their signatures.

    The three documents arrived by mail at The Times with a postmark indicating they had been sent from New York City. The return address claimed the envelope had been sent from Trump Tower.

        They’re not his federal forms though.

      If you’re the person pulling the forms from a locked drawer, yeah, unless you weren’t authorized to pull them, that’s illegally obtaining them.

      If you are a newspaper receiving an apparently anonymous tip that contains those forms, there is ZERO illegality involved.

      Then again, we know Trump doesn’t give a flying rat’s ass about freedom of the press or the 1st Amendment.

      It’s also fascinating for them to claim Trump has paid so very much in taxes and charitable contributions — but they refuse to document any of it willingly.

        When I was in Las Vegas last weekend to volunteer for Hillary we drove past that hideous Trump building and everybody booed.

        Oh, and when we drove by again at night the only thing you could see lit up was the huge Trump sign. As we got closer you could see there were lights on in the building but they must have the windows tinted or something so the only thing you see lit at night is that ugly ass Trump sign.

            In true Trump form, and in keeping with ALL Trump properties, the one in Vegas is steeped in controversy. It was supposed to be all condo from the start. When some purchasers couldn’t close (couldn’t get financing) , they decided to operate it as part hotel, then a year or so ago, it was going part timeshare as well. So the suckers that bought at the beginning, being told this would be a YUGE investment opportunity – got left holding the bag. It’s no longer just a “luxury” condo but a very mixed bag of residents, hotel guests and timeshares.

        Established facts are:
        1. Mr. Mitnick, one of Trump’s original tax accountants, verified the authenticity of these documents.
        2. The postmark is definitely NYC. The return address on the envelope said Trump Tower. Faking that address would absolutely be a hearty ‘fuck you’ to Trump himself…but who the hell knows for sure exactly where it was mailed from. (No word if the return address was hand-written, typed, printed, or was an actual pre-printed Trump Tower business envelope. I’d give anything to have this particular detail.)

        At minimum, it was someone with direct access to these rather old records. Someone with an axe to grind, but who did not want to go public with who they were.

        NYC is huge. You could mail something from any zip code there and be assured you’d never be found if you didn’t want to be.

        • If I had done this I would totally have walked to a Trump building and mailed them from there. Some of those buildings have mail slots in the lobby. That is so genius.

          There have easily been hundreds of people in the last 20 years that had access to some copy of this document.

          At one point in a big bank where I was working they caught a consulting firm (one of the big ones) snooping through files they had no business in. All kinds of people have access to things you’d think they wouldn’t. I say that from experience.

            I work for a financial services software company. Until less than 2 years ago, everyone in the company basically had access to the database of every financial institution running our software. We still have access to the databases, but the data is scrambled. Unfortunately, we also have access to reports and other information that makes it simple to cross-reference the scrambled information with the live data.

            When I first started working here, one of the telephone support reps banked with one of our clients (this bank offered us discounts and incentives – many of the same things offered to the employees of the bank). This rep and her husband had a very acrimonious divorce, and he kept trying to get the alimony and child support reduced. His new wife just happened to work at the bank, and our support person basically used her position to monitor who had been accessing or changing her account so that she could use the information against him, while monitoring his accounts so that she could prove his income. It was well-known up the management chain that she was doing this, and no one really cared.

            You never know who has access to your data.

          • I had access to such a system as a temp. Wasn’t allowed to book company travel because I was a contractor (what I would have done on Sabre and not gotten caught I do not know) but I had access to people’s investment accounts. smh

            There had to have been at least one hard copy of this document somewhere. His office. His accountant’s office. Somewhere. Probably more than one. And dozens of people (conservatively) would have had access over the last 20 years. Making a copy then putting it back would have been easy. The room or the drawer probably wasn’t even locked.

      1. Cut his own tax rates massively (and that of other rich people)
      2. Raise taxes for the poor and middle class
      3. Eliminate most of the programs the poor and middle class depend on, in order to divert still more money to the plutocratic class
      4. Still not raise enough in revenues to avoid blowing at $10 trillion hole in the federal budget because he does want to increase military spending and eliminate corporate taxes.

      However, I have a real problem with the fact that our tax laws are stacked in favor of the rich – such as this law which allows someone to use bankruptcy to avoid taxes. This is the type of thing that stacks the deck against the middle class and damages our economy.

Charles was head of First Baptist Church in Atlanta, and he cheated on his wife for most of Andy’s life. Charles’ wife filed for divorced and then withdrew the legal action. Years later she went through with it. The Southern Baptist Convention has a code that says that divorce is not acceptable and that pastors can not continue in their position if they are divorced. But they looked the other way to allow Charles to continue raking in dollars.

    Charles is still happily preaching at FBC of Atlanta – in Dunwwody, GA.

    His tax plan wants to cut taxes for the top 2 % . Why do you have to cut if they’re not paying anything ? While this news may not hurt him, it destroys his tax plan .

    • Because federal personal income taxes is only a small piece of all the taxes Trumpty-Dumpty wants to cut. He also wants to eliminate the estate tax, most corporate taxes, and allow for the expanded creation of pass-through companies which could potentially drop his actual total paid tax rates even lower. On top of this, his ‘plan’ if you can call it that includes huge breaks for companies looking to bring money back to the U.S. from offshoring, which there is little doubt he’s been doing, too.

      And besides, there may come a year when he wants to drop the “on the books massive losses” scheme in favor of simply being allowed to pay little to nothing in perpetuity.

    So, if I’ve got a $960M loss that I carry forward to eliminate taxes in the next 18 years, doesn’t it mean that, over those same 18 years, I made only $960M in net profits? That works out to about $53M/yr. If the loss occurred in 1995, then we’re talking about this average gain through 2013. Granted that’s a lot of money but you don’t get to “multi-billionaire” that way unless 2014 was a VERY VERY good year.

        What the original call meant about running government “like a business” was that the accountants would track which parts of government generate net revenue and which net expenditures.     The general consensus amongst the Trumpanzees is that he’s a genius for not paying taxes. Many of them don’t pay taxes either, so it won’t be a concern. People with integrity who were considering voting for him, and I’m sure there are five or six, will actually be bothered by this.

        Personally I think releasing his taxes today would have a couple of different reveals, not the least of which would be where his money ties are. That would be more problematic than this. The other thing is that he is profiting from “charitable donations” and this would be a stickier situation for him from a legal standpoint.

          I agree, his tax returns today would be more damaging – someone speculated here last night that this might have been leaked by the Trump campaign itself which is an interesting angle because it changes the topic from Trump’s fumble on Miss Universe as well as the Cuba story. Trump is the master at controlling the Media and it wouldn’t be surprising that they released this particular years tax returns as a strategic play

            The challenge lies with Trump history. Nothing he release will view as positive spin, rather the intension is to create more distraction. It will further validate his incompetence.Through out the campaign, the Clinton camp did not made up any of the attack ads. They are all direct quotes from Trump. Throwing more fireworks into a bonfire by Trump campaign will reach a point of exhaustion. Provided no misstep by the Hillary campaign or more revealing emails from the Putin and Assange, Trump will be Trump worst enemy. It seems the media are slowly turning on him and asking the questions they should have been asking when he toss his hat into the ring.

        He’s not a genius, he’s a cheat. But I already knew that’s how the spin was going to go. Hillary’s made the two points at the debate 1: he’s not as rich as he says 2: he doesn’t pay any taxes. And as far as I’m concerned this just proved those points. But I have a degree in economics and I live in Las Vegas so I have one more take on this: Only one group has seen all his tax returns., The Nevada Gaming Commission. And when they did they denied Trump a gaming license. That’s why he has a hotel and no casino here. When you’re too shady to own a casino you’re too shady to run the country.

    Her loses basically a billion Dollars, so any profits he makes in subsequent years he gets to keep ALL of the profit, and pays no taxes?

      But remember, he did lose $900+ million in just one year. Assuming his return was honest, which it may have been given that it was likely gone over by the eagled-eyed minions of the IRS.

      Here in Canada, the income tax laws allow certain kinds of losses to be carried over from year to year in just the same way.

      It is a reasonable way to handle the situation in which a tax payer’s losses for a year far exceed his gains. Yes, it benefits Drumpf but it would benefit you too if you found yourself in the same boat.

      The amount of the loss is startling. I didn’t know Drumpf was that bad a businessman. But that’s the only newsworthy aspect to this.

      Edit: I sure hope the above is correct! Don’t want to be lynched by a mob!
