Liberty Counsel Has The Roy Moore Sadz

Via tear-stained press release:

Today the Court of the Judiciary (COJ) issued a decision on the charges against Alabama Supreme Court Chief Justice Roy Moore. The Judicial Inquiry Commission (JIC) requested that he be removed from the bench. Under the COJ rules, removal requires a unanimous 9-0 vote by the members of the COJ, which is made up of judges, a lawyer and laypeople. Absent a 9-0 unanimous vote, the COJ cannot remove a judge from the bench.

But today, in an unbelievable violation of the law, the COJ suspended without pay Chief Justice Moore for the remainder of his term, which runs through January 2019. When his term expires, he will be ineligible to run for election as judge again because of his age. So the suspension until the end of his term is a de facto removal from the bench.

“To suspend Chief Justice Moore for the rest of his term is the same as removal. The COJ lacked the unanimous votes to remove the Chief, so the majority instead chose to ignore the law and the rules,” said Mat Staver, Founder and Chairman of Liberty Counsel.

“In August, when both sides asked for summary judgement, I was shocked that the COJ chose not to rule. I surmised then that the COJ lacked a unanimous vote to remove the Chief and so the can was kicked down the road to keep the Chief off the bench for two more months. The evidence and the arguments presented Wednesday showed that Chief Justice Moore should be reinstated. He did nothing wrong. The JIC presented no live testimony or affidavits. The charges should be dismissed. Today’s decision by the COJ to suspend the Chief for the rest of his term throws the rule of law out the window. This system must be changed,” said Staver.

“The rule of law should trump political agendas. Sadly, today that is not the case. What this decision tells us today is that Montgomery has a long way to go to weed out abuse of political power and restore the rule of law,” Staver said.

“The 2016 Administrative Order was merely a status report of the pending case before the Alabama Supreme Court. The order did not change the status quo. It did not create any new obligation or duty. To suspend Chief Justice Moore for the duration of his term is a miscarriage of justice and we will appeal this case to the Alabama Supreme Court. This case is far from over,” said Staver.

Liberty Counsel is filing an appeal of the decision with the Alabama Supreme Court. A new panel of judges will need to convene to hear the case and all the sitting Justices should be recused.

      Also, he claims “To suspend Chief Justice Moore for the rest of his term is the same as removal”. The effect is very similar, but not identical. If they had removed him, the governor could appoint a replacement. Since he’s suspended until the end of his term, now they just have to live with 8 justices.

        Reading it again, I see that it was unanimous. They probably suspended him to keep the governor from appointing a replacement.

          It is actually hidden in a quote from that same article:
          “The Alabama Court of the Judiciary (COJ) issued the order Friday suspending Moore from the bench for the remainder of his term after an unanimous vote of the nine-member court.”

          It sounds like the majority would have removed him from office, but there was at least one holdout, so they compromised on a unanimous suspension.

          Suspension sounds better to me, since the governor of Alabama is a dick, and who knows who he’d appoint in Moore’s place.

They often promise to litigate cases for free to their clients (who are then on the hook for the otherside’s legal fees since these are all religion cases).     What the COJ did was vote to SUSPEND HIM FOR THE REST OF HIS TERM. They did NOT remove him from the bench. Therefore, it their vote was at least 6 in favor, the vote is valid.

    The dispirit is now saying that suspension is the equivalent of a removal from the bench. And therefore, a unanimous decision is required. but of course it is NOT the same thing!

    So for those waiting with baited breath, it’s a very safe prediction that Liberty Counsel will lose this appeal.

    At one point, the judge asks him to read a portion of a lease agreement that he signed, and his lawyer says, “Objection. Mr. Trump isn’t a lawyer.”

    In the part I’ve read so far, he’s managed to make himself look like an idiot about 40 times, but only because nobody could read these responses and believe that they’re dealing with a smart businessman. He also throws his kids (Ivanka and Don Jr.) under the bus every chance he gets. But I haven’t gotten to any of the sexist/racist/xenophobic part yet.
