FLORIDA: “Abolitionists” Launch 2018 Ballot Initiative Calling For Executing Women Who Have Abortions

And their doctors, too. From the press release issued today by Christian Newswire:

The political committee Abolish Abortion Florida (AAFL) has launched a ballot initiative to amend the state’s constitution to punish abortion as capital murder. Under the proposed amendment, anyone who performs or procures an abortion would be charged with first degree, pre-meditated murder.

“Abortion” would include any abortifacient drug or device that can kill an embryo by preventing implantation, as well as the intentional destruction of unwanted IVF embryos. The amendment would define life as beginning at fertilization rather than “conception,” and declares that “abortion deprives an innocent human being of the inalienable right to life, liberty, and the pursuit of happiness.”

According to AAFL, the idea is not only to collect enough signatures to get the measure onto the 2018 ballot, but also to encourage legislators to begin putting forward legislation to abolish abortion instead of merely regulating it. Per AAFL: “The Supreme Court cannot make murder legal. Pro-life politicians have passed incremental regulations for decades, but it’s time to abolish abortion by recognizing it for what it is – cold-blooded murder – and prosecuting it accordingly.”

RELATED: Florida has executed 92 people since the death penalty was reinstated in 1972, most recently in January 2016. Currently there are 412 inmates awaiting execution in Florida.

    • Roe has mostly been upheld in 5-4 decisions going back to 1992. In fact if Kennedy and O’Connor hadn’t surprised conservatives by upholding Roe then it would have been overturned and states would now have wildly differing laws on abortion from legalization to criminalization and everything in between. This election matters. We take for granted that many previous liberal decisions will stand but if you read dissents by Scalia and others you quickly realize that we were often 1 or 2 votes from that being the majority opinion.

  • While I personally believe there should be limits on access to abortion, this is about as extreme a position as it gets.

    On what grounds is a fertilized egg a “person”? That’s a theological assessment, not a legal one. A fully-formed and viable fetus, on the other hand, is a different story. Even then, taking the position that terminating its life is “murder” ignores the possibility of mitigating circumstances.

    It’s kooks like this that make reasonable discussion impossible.

      It’s already happening.

      1. A critically ill, 27-year-old Washington D.C. woman was 26 weeks pregnant when a judge ordered her to have a Cesarean section. He did so with the understanding that the procedure would very likely kill her. It did. The baby died as well.

      2. A pregnant woman in Iowa fell down a flight of stairs and went to the hospital. The hospital reported her to the police who arrested her for “attempted fetal homicide.”

      3. A Utah woman gave birth to twins, one of which was stillborn. Her doctors blamed the death on her decision to delay a C-section. She was arrested for fetal homicide.

      4. A Louisiana woman checked in to a hospital due to vaginal bleeding. She was locked up for a year on charges of “second-degree murder before medical records revealed she had suffered a miscarriage at 11 to 15 weeks of pregnancy.”

      5. A Florida woman “was held prisoner at a hospital to prevent her from going home while she appeared to be experiencing a miscarriage. She was forced to undergo a Cesarean.” She still lost the baby, and her two small children at home were left without her while she was held. A state court ruled that this detention was wrong, although it would have been fine if she was further along in her pregnancy.

      6. Another Florida woman who went into labor at home was picked up by a sheriff, driven to the hospital and forced to have a Cesarean against her will. She filed suit, and the court concluded that the woman’s personal constitutional rights “clearly did not outweigh the interests of the State of Florida in preserving the life of the unborn child.”

      7. A severely depressed, pregnant 22-year-old woman in South Carolina tried to commit suicide. She was jailed for child abuse.

      Do you suppose most people aren’t aware of how babies are made? I think this is general knowledge before one is even capable of having one.

      Let me put it this way: conception is a natural side effect of having sex. It isn’t a bug … it’s a feature. Why is it unreasonable to expect people to accept the consequences of the decisions they make? Are you saying that women are incapable of making such decisions with some level of forethought?

      It isn’t hard to prevent pregnancy: oral contraception is over 99% effective. Then there’s other forms of sex one can have during one’s more fertile times of the month as well. And the guy can wear a condom. If all of these methods were used, the “need” for abortion would dramatically decrease.

        I agree with your final paragraph. And the rest of your position might have merit if the AAFL-types in this country weren’t also rabidly anti-birth control and anti-sex education.

        Even then, I said might because there is a real tension here between (a) an actual, living human being (the woman) and (b) a potential human being (the fetus). We know the consequences of coming down mostly on Side B–back-alley abortions, women and children in poverty, etc.

        Finally, as others have pointed out, there is also a man involved in this act. Where is his acceptance of responsibility? What are his consequences?

          In terms of your word “potential” … what makes someone a “potential” human being versus an actual one?

          What parameters are you using? Legal ones or medical ones? If legal, keep in mind that the law is sometimes arbitrary or at least prone to subjectivity. Some suggest that being a “person” requires a capacity for self-awareness. This immediately eliminates newborns and those in later stages of life with debilitating mental diseases.

          Perhaps the law will reflect those sentiments one day.

            To your first question, I’d be willing to bet that the majority of the AAFL are *men*. I’m not so sure about your assertion that the law *demands* men fulfill their responsibility. Perhaps in theory, but not often in fact (otherwise you wouldn’t see so many young–often poor–women raising children without the father in the picture).

            To your second question, I prefer a medical definition. Certainly there’s a qualitative difference between a blastocyst of a few cells and a fully developed fetus. Where, precisely, that line should be drawn, I’m not qualified to say, although I tend to favor a “later” rather than an “earlier” definition.

        Those methods are already being used. Sometimes they fail. Sometimes couples have sex without protection for whatever reason. Why should that mean that they have to bring the fetus to term? Safe, private and legal abortions and the morning after pill should be available to women at any hospital that takes public money, including hospitals run by the catholic church.
