KENTUCKY: Appeals Court Upholds Contempt Ruling Against Kim Davis For Refusing Marriage Licenses

Via press release from the ACLU:

A federal appeals court today dismissed Kim Davis’s appeals in the Rowan County marriage licensing case. The U.S. Court of Appeals for the Sixth Circuit in Miller v. Davis left in place the order that found Davis in contempt.

ACLU LGBT Project Staff Attorney Ria Tabacco Mar has this comment: “Kentucky’s new marriage law goes into effect this Friday, allowing all loving couples to obtain marriage licenses in the state without fear of discrimination. In light of the changes to the law, the court correctly dismissed Kim Davis’s appeals. Notably, however, the court kept in place a lower court order that found Ms. Davis in contempt for defying the law and denying our clients the marriage licenses they were legally promised. We’re pleased that the appeals court kept that decision on the books: It will serve as a reminder to other government officials that placing their personal views ahead of the Constitution and the rule of law is not acceptable.”

As you’d expect, the Liberty Counsel makes no mention of the contempt ruling.

“We celebrate this final victory for Kim Davis,” said Mat Staver, Founder and Chairman of Liberty Counsel. “We asked the federal court of appeals to set aside the lower court injunctions against Kim Davis. The ACLU objected and today the court sided with Kim Davis. The injunctions are gone and Kim Davis received the accommodation that she requested. County clerks are no longer forced to compromise their religious liberty and conscience rights,” said Staver.

    She did NOT receive the accommodation she was sued for. Let’s not forget that she not only refused to issue licenses, but refused to allow any of her employees to do so either, forcing same-sex couples to go to another county for a license.

    What’s in place now is that she simply doesn’t have to put her name on the licenses her office is legally required to issue. Liberty Council is moving the goalposts just so they can declare a victory. Color me surprised.

Maybe she didn’t stop marriage licenses being issued but she, as a county employee, doesn’t have to sign something that is (was?) part of her job? possibly in her job description? Hmmmm… that’s a little germ-like and I hope that kind of refusal of specified duties doesn’t spread.

        There’s a fine line between ‘reasonable accommodations’ and ‘refusal of duties’. In my opinion, I don’t have an issue with someone recusing themselves from a function that offends their stupid faith as long as others in the office can provide the same service with no inconvenience to the customer. As long as the customer is served, it doesn’t matter to the customer who does it.

        From there, it’s up to the employer to determine if that reasonable accommodation has crossed the line and become an employee who is not earning their salary.

As long as we, the customers, receive the service we are requesting, I don’t think we have to demand that it come from a certain individual. As long as same-sex couples can get licenses without delay in that Kentucky County, who gives a shit if they get them from Davis herself or from one of her staff and whether/not they have Davis’ name on them..? Non-issue to me.

          Why should someone else’s job load and demand for availability be increased to “accommodate” someone who isn’t doing their job? Davis knew this potential requirement was immanent when she last ran for office. Running for public office is not an entitlement for incumbents.

            ‘Reasonable’ is the key word, and (like I said above) it’s for the bosses and employees to figure that out. A good example is the Muslim flight attendant who, for years, refused to sell alcohol on planes… with no issue. Her coworkers had no trouble re-arranging duties so that she could avoid the booze cart. Then, one day, a coworker complained… and the complaint contained racist, Islamophobic undertones… and the lawsuits started.

            Until the complaint, there was no issue… the accommodations her ‘reasonable’ according to all involved, and no passenger/customer complaints because they couldn’t buy alcohol from that one specific flight attendant.

        She never had to sign them. The forms referenced the authority of the county clerk. I don’t remember the details of the change they made, but it didn’t really satisfy her demands. Liberty Counsel (with her cooperation) just pretended they had gotten all they wanted so they could declare a win.

      She refused to let her office staff issue licenses which had her name on them. The accommodation here is that her name was removed from the licenses, so her office (but not Davis herself) will continue to issue licenses… right?

    I’m glad the Court reached this conclusion. Whether or not the governor changed the rules after the fact is moot, she did damage to the lives of those people she denied.     Totally false. The parties BOTH agreed that Kentucky S.B. 216 will deprive the Court of jurisdiction to hear the appeal; and an Order implementing that agreement was entered by the US Court of Appeals for the Sixth Circuit.

    The Court also wrote: “The district court’s September 3, 2015 order holding Davis in contempt of court [DE 75] does not meet the requirements for vacatur under Munsingwear and its progeny, and it is therefore not vacated.” April Miller v. Kim Davis, Nos. 15-5880 & 5978, Order On Appeal From the U.S. District Court for the Eastern District of Kentucky (6th Cir. filed Jul. 13, 2016). Available at:

    Wait, so does the Sixth Circuit’s decision that the conviction for contempt is not vacated, mean that the appeal is still pending as to that conviction? Did she appeal her conviction separately? Hello, ACLU?

    • Davis was appealing three orders issued by the district court: 1. the initial preliminary injunction; 2. a modification of the preliminary injunction; and 3. the order holding her in contempt.

      Davis herself asked that the appeals be dismissed and all of the orders she was appealing be “vacated” i.e., made to go away as though they’d never happened. The 6th Circuit dismissed the appeals, per Davis’s request (and not objected to by the plaintiffs) and did order the district court to vacate the preliminary injunctions. However, the Court did not vacate the contempt order. That order still exists, but is no longer the subject of a current appeal at the 6th Circuit.

      Technically, this decision doesn’t “uphold” the contempt order because the 6th Circuit didn’t make a ruling on the merits. It merely dismissed Davis’s appeal of the order (at her request) and refused her request to make the order go away altogether.

      The entire case now goes back to the district court (after some possible delay to wait for the 6th Circuit to issue a mandate) for proceedings on any unresolved issues.

        I met her both before and after her appointment to the bench. She attended several days of the Michigan marriage trial in Judge Friedman’s court (she used to clerk for him) and she was, of course, at April and Jayne DeBoer’s wedding that I had the honor of attending.
