Roy Moore’s Next Court Date: August 8th

From the Liberty Counsel:

The Court of the Judiciary (COJ) has set an August 8 hearing for oral arguments regarding Chief Justice Moore’s motion to dismiss charges brought by the Judicial Inquiry Commission (JIC). The order states that the court would treat the motion to dismiss as a motion for summary judgment, meaning that the hearing could dispose of the entire case. The JIC must submit a response by end of business on July 15. Each side will have 30 minutes for oral arguments before a full court at the hearing.

The court order noted that the staff has received many phone calls and emails in support of the Chief Justice and has asked both parties to discourage those calls. While the public support is encouraging, it has not been prompted by Chief Justice Moore, his attorneys, or staff.

“We look forward to our day in court,” said Mat Staver, Founder and Chairman of Liberty Counsel, which represents Moore along with Judicial Action Group. “We have stated all along that the JIC lacked jurisdiction to issue the charges. They are baseless and should be dismissed so the Chief Justice can return to the work for which the people elected him,” said Staver.

    Moore, you broke the law. The fact that the only law firm willing to take the case to court loses often because they are trying to apply the bible to secular law says an awful lot about your chances.

    A JUDGE sworn to uphold the LAW did this; and, despite this, the case against him could be DISMISSED?!

    What kind of “court” IS this, yet another Alabama kangaroo court stacked with SEDITIONISTS??

    Do they or do they NOT believe in law and order??

    Are they or AREN’T they LOYAL to the Constitution they SWORE an oath to??

      When will the US federalize Alabama, reduce its status to that of a territory, and appoint legislators, governor, and state judges with men and women appointed by Washington?

      After Alabama, the same regime will be installed in Kansas, Oklahoma, Mississippi, and finally TEXAS.

    Moving for summary judgement means you believe the facts and the law are so compelling for your side that no further arguments or trial are required, and the judge can simply rule in your favor.

    But it is Mat Staver making the motion, and he knows neither facts nor the law, so the judicial slap-down should be epic.

    If it’s treated like a summary judgment motion, then all the opposing side needs to do is create one triable issue of material fact. To succeed, there must be no disputed facts as to a key element of the claim. Like if both parties to an auto accident agree that the defendant ran a red light, then boom, there you go. But if the defendant says I had the green light, then there’s a triable issue of a material fact and there has to be a trial. I can’t imagine it’s that hard to create a triable issue about Moore’s unethical behavior. In fact, those prosecuting the charges against him would, I think, have a better shot at getting such a motion granted.
