ALABAMA: Roy Moore’s Hate Group Says Federal Court Has No Jurisdiction To Enforce SCOTUS Ruling

Yesterday a federal court issued a permanent injunction barring Alabama officials from defying the Supreme Court on same-sex marriage. This afternoon Roy Moore’s Foundation For Moral Law issued a typical response. Via press release:

Foundation President Kayla Moore noted, “Judge Granade’s jurisdiction extends over only the Southern District of Alabama. She has no authority to bind officials in other parts of the State.” She added, “It’s not over just because Judge Granade says it’s over. In fact, her order acknowledges that the Alabama Supreme Court’s March 4, 2016 order denying the parties’ motions and petitions did not vacate or set aside the Court’s March 3, 2015 writ of mandamus directing probate judges to follow the Alabama Constitution. That’s what we’ve been saying all along.”

Foundation Senior Counsel John Eidsmoe stated further, “Much more than same-sex marriage is at stake here; this involves the whole federal versus state relationship in our constitutional system. The Obergefell decision was procured by illegitimate means because two Justices who had personally performed same-sex marriages refused to recuse, and it is utterly devoid of constitutional support. Article VI, Section 2 says the Constitution, federal laws, and federal treaties are the supreme law of the land; it says nothing of federal court decisions. Nothing in the Constitution says every federal, state, and local official has to march to the beat of a federal judge’s drum, no matter how erratic that drumbeat may be.”

Kayla Moore, of course, is Roy Moore’s wife.

PREVIOUSLY ON JMG: In 2014 John Eidsmoe filed a SCOTUS brief which demanded that Ruth Bader Ginsberg and Elena Kagan recuse themselves from all marriage cases. In 2011 Eidsmoe called for Congress to have “ex-gay” torture provided to the US military. That same year he declared that gay service members will molest children. He has also said that all women must submit to their husbands and that the United States must impose biblical laws and punishments or else the nation is doomed. Eidsmoe, NOT incidentally, was Michele Bachmann’s professor at Oral Roberts University.

            Most major symphony orchestras audition without seeing the player who is behind a screen and who conveys any questions for the judges through a 3rd party. Sex, race and all that do not enter into the selection process. I would rather have an orchestra made up of the 100 best possible players than an orchestra made up X number of men, X number of women, X number of this race or that race. The Vienna Philharmonic does, indeed, have women members, though the NY TIMES has started jumping up and down that there are not enough Asian players in it to suit the NY TIMES. Despite all this the Vienna Phil. is still considered one of the very top orchestras in the world (for some it IS the top orchestra and has been for decades), despite not having the politically correct number of both sexes, all races, blahs, blah. And you are right, this is a fantastic performance, one that cannot be touched by any US orchestra.

            Historically, women were conditioned to make music to please mommy and daddy and attract the attentions of a male suitor. Not to make a career out of it. The making of it a career is probably a relatively recent development for women.

            I read something not long ago that said, thanks largely to Europeans coming to the States to conduct and teach, that there are many U.S. orchestras today on a par with their European brothers and sisters, and that, sadly, some European orchestras were beginning to slip.

            It sounds like exactly the right way to do auditions! But it really does surprise me that so few women make it through this process in Vienna.

About a decade ago, the Austrian government told them that if they didn’t start having blind auditions like other orchestras and admitting women, they would lose their government funding. They made the decision to stay as they were and are now privately funded.

            The Boston Symphony was the first orchestra to employ the blind audition policy. It wasn’t long before they noticed that women were being hired much more often, and they even had their first female principal player, the flutist Doriot Anthony Dwyer, who still thinks that if she didn’t have an odd name, she never would have gotten an audition.

    Nothing in the mother fucking Constitution says that any Supreme Court Justice is required to recuse for conflict of interest and these bigots know it. If that were the case every dirty decision touched by Antonin “Weekend at the Lobbyists” Scalia and Uncle Clarence “Just Take Care of Jinny” Thomas would be vacated.
    A Supreme Court Justice should avoid the appearance of impropriety, but it is unamusing how that standard is only bemoaned when applied to Progressives.

    • There have been cases where a justice recused him/herself, most recently Elena Kagan who had actually worked on the case much earlier in the process. Of course she did the ethical thing and stepped aside. You are right about Scalia and Thomas, both of whom took bribes. Scalia died while on an expensive trip paid for by someone with business before the court.

      The issue before the court wasn’t whether same sex marriages were good or bad, but whether states had the authority to ban them. The justices performed the marriages in Maryland, where equality was implemented by popular vote, and DC where it was done by legislation. There would only be a conflict of interest if they had performed them in states where the bans had been struck down by the federal courts. Which they did not do.

      No conflict of interest whatsoever.

      Indeed, if one wants to see a real conflict of interest, Roy Moore doesn’t have any further to look then his own court, where fellow Justice Tom Parker refuses to recuse himself from hearing cases the FOFT hate group for Alabama, the Alabama Policy Council brings to them.
      Might not be a big deal other then the fact he is the co-founder of said hate group, which means he really shouldn’t be hearing cases they bring to the court.
      But of course, Moore and others ignore that.
      As you said, only Progressives have to recuse themselves, not conservatives.

      A justice could believe that same-sex marriage was not a federal constitutional right, but a state’s decision, and perform a SSM in a state where it is legal. The question before the court was not “can gays get married” but “can SSM be barred in certain states without violating rights under the federal constitution”

The justices who performed the marriage ceremonies were doing something that was legal, and the question before the court was not whether SSM should be allowed in the states, but whether it was a federal right. (Not that i don’t believe that judges can hold opinions, and yet be impartial).

        For one thing, where the same-sex weddings were performed, it was perfectly LEGAL, recognized by LAW where they were performed.

        For another, Scalia and Thomas never made any secret of their opposition to the ACA, but did NOT recuse themselves from cases dealing with it. The same can be said of their opposition to marriage equality, and Thomas has had PHOTOS taken of himself with anti-LGBT activists.

        The hypocrisy of those complaining about Kagan and Ginsburg is GALLING.

    The Supreme Court of Canada has upheld the acquittal of a British Columbia man in a decision that defines the crime of bestiality as penetration involving a person and animal.

    The B.C. man was found guilty three years ago of 13 counts arising from years of sexual molestation of his two step-daughters.

    The charges included one count of bestiality under the Criminal Code, stemming from sexual activity involving the older girl and the family dog.

    The man successfully challenged the bestiality conviction in the B.C. Court of Appeal based on the fact the activity did not involve penetration. (The man cannot be named to protect the identities of the step-daughters.)

    In a 6-1 decision Thursday, the Supreme Court affirmed that ruling, rejecting the notion bestiality is an offence encompassing sexual activity of any kind between a person and an animal.

    “The term ‘bestiality’ has a well-established legal meaning and refers to sexual intercourse between a human and an animal. Penetration has always been understood to be an essential element of bestiality,” wrote Justice Thomas Cromwell on behalf of the court.

    “Parliament may wish to consider whether the present provisions adequately protect children and animals. But it is for Parliament, not the courts, to expand the scope of criminal liability for this ancient offence.”

    In a dissenting opinion, Justice Rosalie Abella said she had a great deal of difficulty accepting that in modernizing amendments to the Criminal Code, “Parliament forgot to bring the offence out of the Middle Ages.”

    A good case can be made that by 1988, Parliament intended, or at the very least assumed, that penetration was irrelevant, she wrote.

      This is such a “male centered” point of view, that sex only occurs if penetration is involved. Look at the hullaballo here in the states with Stanford Rape case. One argument for leniency is that it wasn’t “real” rape because his penis never penetrated her.
      I beg to differ. Just because there is not penetration does not mean rape did not occur. I think some laws need to be changed.

        Our laws on sexual assault of humans do not require penetration.

        In the criminal code of Canada, bestiality itself is not defined, but has always been considered by the courts to mean anal or vaginal intercourse with an animal.

        I imagine the government might get around to it during the next major revision of the code, but I wouldn’t expect them to make it a priority.

        The section on anal intercourse needs to be removed in its entirety.

  • on a side note the idea that Justices that performed same sex marriages must reuse themselves is absurd. that a justice officiates a same sex marriage in a jurisdiction in which it is legal does not mean that they will rule that all justification must let same sex couples get married. also using their logic any justice that ruled agasint decriminalizing homosexuality should have also rescued themselves as they also would have been biased in the case. they have ZERO argument, they are just grasping at excuses to not recognize the Courts ruling on this.

The other side need only tell the other district judge, if it comes to that, “Well, Your Honor, the ruling is in something F.Supp. something, and we move for summary judgment.” And in any event, the 11th Circuit could hand down a ruling on this case in short order, if it’s settled law.
