NORTH CAROLINA: School Board Member Says New Pepper Spray Rule Will Be Useful Against Trans Students

High school students will be allowed to carry mace in the 2016-2017 school year after the Rowan-Salisbury Board of Education agreed to remove prohibitive language and amend its policy.

The board spent some time at its Monday work session in the Wallace Education Forum debating whether pepper spray and other defensive sprays, as well as personal shaving razors, should be allowed on school campuses.

Board member Chuck Hughes was in favor of the sprays on campuses, saying that in his mind, they were purely defensive. He also referenced HB2, saying that the sprays might be useful.

“Depending on how the courts rule on the bathroom issues, it may be a pretty valuable tool to have on the female students if they go to the bathroom, not knowing who may come in,” he said.

Knocked a loser on his ass when he tried to throw me around, and I was the one punished because my behavior wasn’t “conducive to non-violent issue-resolving”. The little shit who tried to push me down a flight of stairs was supposed to get a written apology from me for bruising his ego. My mother heard that bs and took me out of there that same day.

      I spoke directly with the gentleman mentioned in the article above for exactly 1h43m minutes today

      I pointed out to him giving students pepper spray is basically giving them weapons.. Plus if someone is allergic to pepper spray it could cause blindness and possibly anaphylactic shock and SUE the school would basically be ruined by 20 million Dollar lawsuit – not just the school but the school board and the entire school district

      I made an analogy to him that he could understand. First of all I told him I was gay male and married to my husband to 13 years, and I told him let’s say you and I were out at a restaurant, and you saw me eating dinner with my husband, and in the bathroom I just simply happened to say hello while I was washing my hands, you felt I was hitting on you and you pepper sprayed me. I informed him he would be charged with assault and battery and would either face fines and/or possible jail time. There’s also the problem if a trans, or just a regular non-Tran student is pepper sprayed with no other witnesses it’s he said versus he said situation – or whatever pronoun you want to substitute. I explained that no student needs any sort of weaponry to defend themselves on school grounds.

      I also said that bullying is a huge problem in the K-12 system and pepper spray would be used to bully both heterosexual, homosexual, and transgendered teenagers as well as other teenagers with identity issues

      He already told me that the board had regretted making the decision, and they are going to reverse it. However he did mention one thing in that they could not prevent students from caring pepper spray in their car because that was considered private property. Said pepper spray will be listed amongst the “weapons” no longer allowed on school grounds – but telling students it’s OK to keep it in their car is a bit odd as that is private property but it is also on the school grounds and if anything happens while on school grounds – like a student taking it out of the car and pepper spraying another student getting into their car that the board be held responsible

      So he said they would reconsider not even allowing students to keep it in their car well on school grounds

      He basically had very little education on what transgendered me and I gave him one

      I may have given him the education some LGBT people would not like. But I gave it nonetheless and I’m not the spokesperson for our entire community

      I explained to him that transgendered people are born with a partner their brains that are reversed which creates a gender identity problem and the only way to fix it is to transition i, physically , into the opposite sex – either in full or part. This kind of threw him for a loop but I explained it best using female to male transitioning. I explained that female to male can look abdrogynous ….to your average male… To muscled, bearded, hairy men, and various combinations. I told him that all of those are a partial transition because the person still could have their original biological sexual organs. One the person has SRS they are no longer transgender but transsexual because they have 100% transitioned

      He asked why so many I don’t transgender’s don’t do this (have SRS) and say why do people care whether we do it or not. I told him the best way were to speak to several transgender’s and transsexuals, but I would try to explain it to him the best I could. I explained to him that before the Obama healthcare administration all SRS was considered elective (even breast removal or adding them)… “Top” surgery was far more cheaper than “bottom” surgery. For a long long time many transgendered people could only afford “top surgery” and even then for many it took years of saving and they could not afford bottom surgery, but now with the Obama ACA act insurance companies must pay for it if – and there’s a big if, The transgender’s psychologist/psychiatrist and doctors that they are seeing sign off on it saying that it is absolutely necessary for the patient’s well-being.

      Clearly high school students arent going to transition like adults unless they are taking hormones which most do not. I agreed with him that this does pose a problem. Because then when transgendered students use the opposite changing rooms it’s not like the girls are going to have another girl in the room with them.

      Suggested the best alternative would be allowing the students to use the PE teachers private bathroom to change and use the facilities… And other faculty bathrooms outside of physical education.

      He had some concerns that these bathrooms were private and lockable and could be abuse for drugs or sex or whatever, and I did agree with him on that. That no student should just be able to access a lockable bathroom at will. The trans student would need to let their teacher know they need to go to the bathroom, or if not in class they need to seek out a faculty member Who would escort them to the bathrooms and remain nearby to make sure I second person was it let in and to allow a reasonable amount of time for the person to use the bathroom. If they simply have to pee , 5 minutes maximum is more than needed.. They need to have a bowel movement then they wouldn’t let me to allow the student 10 to 15 minutes – unless the student was sick and needed longer…he was the one that actually brought up the time limits because he feared it would become a strain on faculty to not have them and that if a student did sneak in contraband that unlimited time would allow them to use it which I actually agree with him – I don’t like it because no one should have to have a time limit to use the bathroom. I have BPH and sometimes it takes me 20 minutes to some times to take a pee… But this would not be a problem for a high school student… But what if they’re constipated or had diarrhea or something that required more time. He said that was something the board would have to discuss and come up with something that is fair and reasonable

      Lastly the board he said would only consider allowing actual transgender students to use the faculty bathrooms… This means a student just simply can’t claim transgender or no gender or third gender or non-binary … They actually have to have a letter from a psychologist or psychiatrist – whichever one is the MD stating the student is actually transgendered..any other gender identity issue the board will not consider because he said “how can somebody transition into something that doesn’t exist?” (Non binary, no gender, 3rd, etc). I completely agree with him. While I believe we should respect anybody with gender identity issues and respond to them and treat them with dignity and respect and asked that somebody use a certain pronoun with them then we should use that, but that a bathroom solution is only really a viable option for transgender’s, transsexuals, and hermaphrodites ( which is a totally different situation, but often hermaphrodite’s can take a while to settle down on which gender they want to be and it may not be the gender they’re born with). If someone cannot identify their gender as male or female then we do not have a bathroom facility that fits them other than a gender neutral bathroom..With trans students, you may have at most 1-20 at any given time even in the biggest schools or even in the biggest cities.. More if you count all of these new gender identities that have cropped up in the last 5 to 15 years – mostly 5 to 10…. The problem with accommodating all of these new identities that a school simply does not have the staff to escort 50-100 students a day to the bathrooms. I wish society could accommodate every gender issue when it comes to the bathroom, but right now it is just not feasible or affordable for many places. Optimally it would be best if every place in the world had male, female, and neutral bathrooms both public and private .. And when it comes to schools eventually it would be best if they have male and female and neutral public-school bathrooms. But you can’t simply just add a neutral bathroom as once the space in the building is allocated it is allocated unless you remove the classroom to replace it with the bathroom – and most schools are underfunded as it is… if the school can afford it then they should because that will not only help transgendered students but other gender identity students in crisis. As far as laws being passed actual bathroom laws being passed, I do not think those laws should extend beyond transgender and transsexual – which includes hermaphrodite’s because they in a sense have to transition or stay as they are so I sort of put them in the same category.

      When Talking to him on the phone he did not sound like the guy that is portrayed in the articles I read… However he also could’ve been telling me exactly what I wanted to hear and lying his face off – I’ll have to see when the school board meets later this week or next week and see what they do

      ALSO THE FACT THE I DONATE SUMS OF $$ TO HELP THE NC school system, gives me a certain influences in this arena where people will take my call or listen to me because if I were to pull my help, certain things wouldn’t happen. .,.,

            I went to Catholic high school. We were allowed to sit on the floor in the corridor during “independent reading” class. I always sat with Rod and Tonka. I was top of the class, they were bottom of the class. I was shrimpy. They were huge. But we shared nerddom. We also shared silliness. One day, Rod decided it would be fun — not for the first time — to smoosh an oreo in my face. Hilarity was about to ensue, but the principal, Sister John Carroll, unfortunately rounded the corner just at that moment and saw what she assumed was a bully assaulting me. A formidable, terror-inducing figure, she swooped in (if that’s possible for a 250 lb woman) and grabbed the oreo and smooshed it in Rod’s face. (I can only assume she was under a lot of stress that day.)

        In this part of PA, it’s those damned school taxes that are pretty much the only issue that any candidate takes a stand on. The GOTP candidates have learned their dog whistles. These three TP friends got in – it’s a five member board – and would meet outside of board meetings to decide what they were going to do, then they’d come to the meetings and shut the other two members out entirely. Totally against the “rules,” but what to do? They did get voted out, or at least two of them did so they no longer had a majority. Unfortunately, one of the other members, who was quite good, quit because of them.

    HB2 will be pulled either by NC or, eventually, the Supreme Court. However, damage has been done. The general atmosphere has shifted. The haters now believe they are justified in their bigotry. What used to be second looks and the occasional stare has turned into “if looks could kill” level staring and harassment. I was followed all around Wal-Mart by at least one old lady. Naturally, I sent her on a chase and covered far more area than planned just to watch her peer from the ends of aisles and behind pillars. I’m sure she half expect me to sprout horns and rape a baby or something. The atmosphere has definitely changed and no matter the outcome, it will take quite some time to recover. While NC has never been a great place for trans folk, it has gotten much, much worse. Sadly, you won’t hear this on the news because it lacks the sensationalism of a bathroom bill. Every day I go somewhere, I’m afraid. Not metaphorically but literally afraid that one of these redneck yahoos will start something they believe should be finished with violence.

        In 1973 I had a 6th grade nun named Sister Jean. She was young, maybe mid-twenties as opposed to all the other nuns that were in their 60’s and 70’s.

      Honestly, homeschooling was a godsend for me when I dropped out of school in the 8th grade due to bullying and the administration not doing anything about it. My Grandmother researched a bunch of correspondence schools (pre-internet days) and enrolled us (me and my brother) in the best one she could find. The quality of the education was better than the local public schools and no religious b.s to be seen anywhere.

You can’t allow a certain group of people or students to arm themselves and not another – it would be all students would be allowed to carry it for safety or not at all. So LGBT people would be able to pepper spray someone who would cause them harm – but that’s besides the point as no student should be allowed to carry this at all because people are allergic to it and it could lead to anaphylactic shock, blindness, and other problems … Science most states considered being sprayed with pepper spray as an act of physical assault unless you are being assaulted yourself or are in imminent danger of being assaulted or losing your life

    I spoke directly with the gentleman mentioned in the article above for exactly 1h43m minutes today

    I pointed out to him giving students pepper spray is basically giving them weapons.. Plus if someone is allergic to pepper spray it could cause blindness and possibly anaphylactic shock and SUE the school would basically be ruined by 20 million Dollar lawsuit – not just the school but the school board and the entire school district

    I made an analogy to him that he could understand. First of all I told him I was gay male and married to my husband to 13 years, and I told him let’s say you and I were out at a restaurant, and you saw me eating dinner with my husband, and in the bathroom I just simply happened to say hello while I was washing my hands, you felt I was hitting on you and you pepper sprayed me. I informed him he would be charged with assault and battery and would either face fines and/or possible jail time. There’s also the problem if a trans, or just a regular non-Tran student is pepper sprayed with no other witnesses it’s he said versus he said situation – or whatever pronoun you want to substitute. I explained that no student needs any sort of weaponry to defend themselves on school grounds.

    I also said that bullying is a huge problem in the K-12 system and pepper spray would be used to bully both heterosexual, homosexual, and transgendered teenagers as well as other teenagers with identity issues

    He already told me that the board had regretted making the decision, and they are going to reverse it. However he did mention one thing in that they could not prevent students from caring pepper spray in their car because that was considered private property. Said pepper spray will be listed amongst the “weapons” no longer allowed on school grounds – but telling students it’s OK to keep it in their car is a bit odd as that is private property but it is also on the school grounds and if anything happens while on school grounds – like a student taking it out of the car and pepper spraying another student getting into their car that the board be held responsible

    So he said they would reconsider not even allowing students to keep it in their car well on school grounds

    He basically had very little education on what transgendered me and I gave him one

    I may have given him the education some LGBT people would not like. But I gave it nonetheless and I’m not the spokesperson for our entire community

    I explained to him that transgendered people are born with a partner their brains that are reversed which creates a gender identity problem and the only way to fix it is to transition i, physically , into the opposite sex – either in full or part. This kind of threw him for a loop but I explained it best using female to male transitioning. I explained that female to male can look abdrogynous ….to your average male… To muscled, bearded, hairy men, and various combinations. I told him that all of those are a partial transition because the person still could have their original biological sexual organs. One the person has SRS they are no longer transgender but transsexual because they have 100% transitioned

    He asked why so many I don’t transgender’s don’t do this (have SRS) and say why do people care whether we do it or not. I told him the best way were to speak to several transgender’s and transsexuals, but I would try to explain it to him the best I could. I explained to him that before the Obama healthcare administration all SRS was considered elective (even breast removal or adding them)… “Top” surgery was far more cheaper than “bottom” surgery. For a long long time many transgendered people could only afford “top surgery” and even then for many it took years of saving and they could not afford bottom surgery, but now with the Obama ACA act insurance companies must pay for it if – and there’s a big if, The transgender’s psychologist/psychiatrist and doctors that they are seeing sign off on it saying that it is absolutely necessary for the patient’s well-being.

    Clearly high school students arent going to transition like adults unless they are taking hormones which most do not. I agreed with him that this does pose a problem. Because then when transgendered students use the opposite changing rooms it’s not like the girls are going to have another girl in the room with them.

    Suggested the best alternative would be allowing the students to use the PE teachers private bathroom to change and use the facilities… And other faculty bathrooms outside of physical education.

    He had some concerns that these bathrooms were private and lockable and could be abuse for drugs or sex or whatever, and I did agree with him on that. That no student should just be able to access a lockable bathroom at will. The trans student would need to let their teacher know they need to go to the bathroom, or if not in class they need to seek out a faculty member Who would escort them to the bathrooms and remain nearby to make sure I second person was it let in and to allow a reasonable amount of time for the person to use the bathroom. If they simply have to pee , 5 minutes maximum is more than needed.. They need to have a bowel movement then they wouldn’t let me to allow the student 10 to 15 minutes – unless the student was sick and needed longer…he was the one that actually brought up the time limits because he feared it would become a strain on faculty to not have them and that if a student did sneak in contraband that unlimited time would allow them to use it which I actually agree with him – I don’t like it because no one should have to have a time limit to use the bathroom. I have BPH and sometimes it takes me 20 minutes to some times to take a pee… But this would not be a problem for a high school student… But what if they’re constipated or had diarrhea or something that required more time. He said that was something the board would have to discuss and come up with something that is fair and reasonable

    Lastly the board he said would only consider allowing actual transgender students to use the faculty bathrooms… This means a student just simply can’t claim transgender or no gender or third gender or non-binary … They actually have to have a letter from a psychologist or psychiatrist – whichever one is the MD stating the student is actually transgendered..any other gender identity issue the board will not consider because he said “how can somebody transition into something that doesn’t exist?” (Non binary, no gender, 3rd, etc). I completely agree with him. While I believe we should respect anybody with gender identity issues and respond to them and treat them with dignity and respect and asked that somebody use a certain pronoun with them then we should use that, but that a bathroom solution is only really a viable option for transgender’s, transsexuals, and hermaphrodites ( which is a totally different situation, but often hermaphrodite’s can take a while to settle down on which gender they want to be and it may not be the gender they’re born with). If someone cannot identify their gender as male or female then we do not have a bathroom facility that fits them other than a gender neutral bathroom..With trans students, you may have at most 1-20 at any given time even in the biggest schools or even in the biggest cities.. More if you count all of these new gender identities that have cropped up in the last 5 to 15 years – mostly 5 to 10…. The problem with accommodating all of these new identities that a school simply does not have the staff to escort 50-100 students a day to the bathrooms. I wish society could accommodate every gender issue when it comes to the bathroom, but right now it is just not feasible or affordable for many places. Optimally it would be best if every place in the world had male, female, and neutral bathrooms both public and private .. And when it comes to schools eventually it would be best if they have male and female and neutral public-school bathrooms. But you can’t simply just add a neutral bathroom as once the space in the building is allocated it is allocated unless you remove the classroom to replace it with the bathroom – and most schools are underfunded as it is… if the school can afford it then they should because that will not only help transgendered students but other gender identity students in crisis. As far as laws being passed actual bathroom laws being passed, I do not think those laws should extend beyond transgender and transsexual – which includes hermaphrodite’s because they in a sense have to transition or stay as they are so I sort of put them in the same category.
