OHIO: Wingnut Lawmaker Floats “Bathroom Bill”

Notorious crackpot Ohio state Rep. John Becker wants a North Carolina-style anti-trans “bathroom law” in his own state. Cincinnati.com reports:

Becker, R-Union Township, is floating a proposal that he says would protect Ohioans from sexual predators posing as transgender people to gain access to women’s bathrooms, possibly by requiring transgender people to use unisex or single-stall bathrooms.

He cited a Seattle case where a man, apparently making a point about the city’s nondiscrimination laws, undressed in a women’s locker room. The conservative American Family Association raised similar concerns while protesting Target’s transgender bathroom policy, which allows customers and employees to use the restroom that corresponds with their gender identity. “It sounds like it’s a concern for John. It’s not much of a concern for those who live in the real world.”

“My concern is sexual predators posing as transgender people to gain access to women’s facilities,” said Becker, who represents northwestern Clermont County. “I’m not suggesting that transgender people are sexual predators. I’m sure the vast majority are honest citizens going about their daily business.”

But LGBT advocates say Ohio already laws against sexually assaulting anyone anywhere, which would include bathrooms. Becker’s proposal would solve no problems, and only create angst for transgender people, Equality Ohio spokesman Grant Stancliff said.

You may recall that in 2014 Becker called for impeaching the federal judge who had ruled that the marriage of Jim Obergefell should be recognized on his late husband’s death certificate. And we all know how THAT worked out. (Tipped by JMG reader Debra)

I have the same issue with one of the Gaither gospel singers, Guy Penrod. He has a sort of Sam Elliot quality to him, and a huge…voice. I dislike that he makes my nipples hard.

    i kind of get the idea that the Ohio GOP leadership will quietly kill this idea …. not for any ethical reasons, but because their Governor is a presidential candidate, RNC convention is there and they’re trying to defend a senate seat that could flip.

      It amazes me that they are so insanely fearful of all kinds of imagined harm that might come from a transgender person using a restroom the GOP doesn’t agree to, when there hasn’t been case #1 of a problem in places where trans people can use the bathroom that feels right to them, while at the same time, the GOP ties the country in knots to avoid even the smallest, common-sense step to curb gun violence, which a very real problem with a long and tragic list of bodies to show for it.

        I feel the same way. This current hysteria about trans people using the bathroom of their choice is mind-boggling. It’s the Right’s latest boogeyman. Don’t get me wrong–they still hate and fear gays, Moslem’s and secularists but they have added trans people to their list of people they despise.
        Now we have them wringing their hands over all the supposed sexual assaults that are gonna take place in the ladies room. Yep big burly guys wearing women’s wigs are gonna rush in and rape little Susie. At least that is how it plays out in their vivid imaginations. Remember their fear-mongering when gays were allowed to openly serve in the military? The Right was screaming that gay soldiers would be raping their straight colleagues in the showers. Yep there was gonna be a rape epidemic! So what happened? Nothing. No rapes. No straight soldiers pressured into sex. Just like there is gonna be no rapes in the ladies room by trans people.

      Doesn’t Ohio already have laws on the books regarding sexual predators?

      Their point, such as it is, is that a claim of transgenderism on the part of a suspicious lurker is enough to stop police from doing anything. I would say they’re crazy, but there have been a couple cases at least where people were too accommodating to even ask the lurker what was going on or press him for proof. It’s a bit of a mess, but nothing a jury couldn’t figure out.

        In reality, trans people aren’t likely to be lurking by any rational definition, unless the stalls are backed up, and in a ladies room, that would mean watching women touch up their makeup and wash their hands.

        In practice, however, a trans person wouldn’t have to be doing anything other than existing for a certain type of person to claim all sorts of horrors on their part.

    semi-OT: I wish I could report that the very recent “bathroom” victory in Virginia was final. (The Fourth Circuit Court of Appeals ruled in favor of Gavin Grimm so their decision covered VA, WV, NC, SC and MD.) Unfortunately the Gloucester County School Board announced it will appeal the decision to the full circuit court.

      The appeal is actually a good thing, in an unfortunate sort of way. Because these laws aren’t going away, in one form or another, without the intervention of the courts, and we need to get them to as many applicable circuit courts sooner rather than later.

      It’s not going to be settled until it gets to SCOTUS.

      At the same time, remember, the court ruling was not about the general constitutionality or unconstitutionality of discrimination against trans people, but about the constitutionality of the Department of Education choosing how to interpret the language of Title IX as it relates to public schools. The court did not declare that the federal government was required to interpret it that way, but only that it could legitimately do so.

      So to be overturned, the full court would have to find that the federal government is constitutionally obligated to discriminate against transgender students. That’s simply unlikely to happen.

      That court ruling really had nothing directly to do with “bathroom bills” outside of the context of public schools. So, it’s also vastly less likely to get overturned on some sort of general principle. That means it is likely to stand as, if not a precedent, a solid factor counting AGAINST such broader laws as they face their own, independent challenges.

      We’ve had one circuit court declare that LGBT people require heightened scrutiny already. Others (though not in the South any time soon) will likely follow.

      It’ll take 5 – 10 years, but it’ll eventually happen. Sucks in the meantime, and absolutely every reason to pursue other avenues toward equality, but that’s how this part of the system works.

  • If we want to make bathrooms safer, I suggest banning republican elected officials as a start, since they are much more likely to molest children and sexually assault women than transgender people.

    What makes it even more clear that these laws are not intended to protect women and children, is that there isn’t any movement by the creepy pedophile and pedophile-enabling Republican legislators like this John Becker, to enact a ban on registered sex offenders in public restrooms.

    Instead, pedophile lovers like Becker and Creepy Ted Cruz are using these anti-trans bills as misdirection ploys, to lull the ignorant hoi polloi into feeling “safe” while the real molesters are hard at work.

    This is just like the old Boy Scout ban on gay scout leaders – that never stopped pedophiles from becoming scout leaders. The people most likely to be child molesters are youth group leaders (including scouts), coaches, priests and other trusted religious leaders, in addition to ultra-conservative Republican elected officials.

    A permanent effect of these bathroom bills, passed or not, is that it may extend the notion, the libel, that trans people are somehow a predatory threat. We’ve already seen how they’ve made bathrooms a problem that didn’t exist before, a problem entirely made up. This will simply focus the problem, on people who already are in danger of physical attack or worse. And it will get worse with each airing.

    The reason for this bill is understandable because the occurrences of sexual attacks and molestations in women’s restrooms has become stratospheric. Something has to be done to stop these terrible crimes. I’m sure he’s done his homework and been horrified at the overwhelming number of citizen complaints made; police reports filed; and court cases adjudicated concerning this awful problem.
