NOM Loses AGAIN: Court Smacks Down Legal Fees

The Fourth Circuit Court of Appeals today smacked down NOM once again, rejecting their demand for nearly $700,000 in legal fees from their losing battle with the IRS. Because NOM had been awarded $50K for the accidental release of their tax returns, they claimed themselves to be the victors even though they lost every other contention made in their suit. From the ruling via Equality Case Files: “We conclude that the government’s position was substantially justified. As a result, NOM is not a ‘prevailing party’ and is therefore not entitled to attorneys’ fees.” BOOM.
