UTAH: HRC Files Complaint Against Anti-Gay Judge

The Human Rights Campaign today filed a formal complaint against Judge Scott Johansen with Utah Judicial Conduct Commission. From their letter to the commission:

On behalf of the Human Rights Campaign’s (HRC) more than 1.5 million members and supporters nationwide, I write to call your attention to a formal complaint that we have filed with the Commission regarding Judge Scott Johansen of the 7th District Juvenile Court. We are deeply concerned by reports that Judge Johansen ordered the removal of a minor child from the home of foster parents April Hoagland and Beckie Pierce of Carbon County explicitly citing their sexual orientation as the driving factor behind his decision. As our complaint states, this directly violates Section 2.3 of the Utah Code of Judicial Conduct, which prohibits discrimination on the basis of sexual orientation.

This Section explicitly provides that “A judge shall not, in the performance of judicial duties, by words or conduct manifest bias or prejudice or engage in harassment, including but not limited to bias, prejudice, or harassment based upon . . . sexual orientation.” Beyond this clear violation of the Code of Judicial Conduct, Judge Johansen’s actions are deeply harmful to all parties involved. The baby had been successfully placed with the couple for three months and the parents intended to legally adopt the child. The biological mother of the child and Utah’s Division of Child and Family Services are supportive of the foster parents and their wish to include this baby as a permanent member of their family. This removal shows how invidious discrimination directly harms those whom our laws seek most to protect.

    In my opinion when a Judge explicitly violates the law based on his bias, prejudice, and bigotry such as in this case, he no longer should be in a position to be a judge. How is he going to be trusted to be fair when a gay person comes before him for anything?

      I’d say he’s just proved that he is incapable of being fair to any person that does not align with his religious beliefs. He stated it plainly. The fact that he removed that sentence doesn’t make the fact that it was there go away.

      He needs to be investigated by an impartial peer review board and removed from the bench while that happens.

      In my opinion, when a Judge explicitly violates the Constitution based on bias, prejudice and bigotry such as in this case, he should face capital charges and if convicted, should be subject to execution by the State. With great authority, comes great Responsibility. In a Perfect Work there would also be great Accountability.

      Yes, this would mean that in cases like Bowers v. Hardwick, or Lawrence v. Texas, or U.S. v. Windsor, or Obergefell v. Hodges, that Justices like Scalia, Alito, Thomas, Roberts et al would be subject to capital prosecuion and possible (okay probable…okay definite) capital punishment for their attempts to deny Equal Protection and Equal Dignity to LGBTs. But it is the only sure way to rid this country of religious-infected judiciary and guarantee Equal Rights for all Americans.

      May nature hasten what the gods cannot.

        Nope, he can’t be trusted to not just subvert the law more subtly and must go. He was making a stand against the law almost certainly on the basis of his religion which is completely unacceptable for a judge. Excusing him just because it appears to create more political fodder for our enemies is not an option. They will make up lies against us no matter what we do anyway.

    A judge (Gary Tabor) in Washington State publicly declared he would not perform marriage for same sex couples and instead asked his clerk to find a different judge to perform the marriage. He continued to perform marriages for opposite sex couples. The Washington State Judicial Commission called him on it and since performing marriages by judges is voluntary he was told he would have to perform all marriages and not pick and chose. So he no longer performs marriages.

    Yet he is still allowed to judge gay people in other court situations. In my mind he’s already shown explicit prejudice toward gay people and should be removed as a judge.

    OT: Several reported dead after explosion, shooting in Paris.

    Gunfire at a restaurant has killed at least two and wounded seven in Paris. French television has also reported an explosion outside a soccer stadium where Germany and France are competing in a friendly.

    Police in Paris say a shootout in a restaurant left at least several dead and wounded in the 10th arrondissement of the French capital on Friday evening.

    Separately, an explosion was reported at a bar near the Stade de France north of the capital. Witnesses at the stadium reported hearing two explosions.

    It is unclear whether the violence is linked.

    French broadcaster BFM TV is reporting two dead and at least seven wounded. Witnesses have reported at least three dead, according to Reuters.

    The German national team is in Paris playing a friendly match with the host country’s national team. Earlier Friday, an anonymous caller caused a bomb scare at the hotel the Germans were staying in.

    Police using bomb-sniffing dogs were unable to find a threat, and the players were able to return to their hotel.

            France has a large Muslim population. If that is who did this, they are there and don’t have to worry about flying and getting into the US. This is indirectly an attack on the US because many Americans only journey outside the US is to Paris.

    There have been complaints about this judge before and nothing was done.
    I’m not holding my breath that he’ll be accountable this time either, judges don’t like to hold other judge accountable most of the time.

        That’s right. The hearing is scheduled for Dec. 4 and he could still order the child removed from her family. Fortunately, no one is with this guy. The governor, who’s no friend to us, has come out strongly against this action; DCFC opposes the action and the guardian at litem supports the family. I hope he gets the message; this family has been put through enough, but he’ll be reversed if he sticks to his guns.
