BREAKING: Kim Davis To Be Freed Today [UPDATED]

CNN confirms that federal Judge David Bunning has ordered the release of Kim Davis now that same-sex marriage licenses are being issued. HOWEVER Davis is reportedly threatening to attempt to stop any further licenses from being issued. CNN reporter: “We might just have to go through this again.” Story developing…..

Rowan County Clerk Kim Davis is to be released from jail in Grayson, Kentucky, a judge ordered today, nearly a week after Davis was jailed for refusing a judge’s order to issue marriage licenses, including to same-sex couples. “After remanding Defendant Davis to the custody of the U.S. Marshal, five of her six deputy clerks stated under oath that they would comply with the Court’s Order and issue marriage licenses to all legally eligible couples,” an order issued by U.S. District Judge David Bunning said. “On September 8, 2015, Plaintiffs filed a Status Report at the Court’s behest. According to the Report, Plaintiffs have obtained marriage licenses from the Rowan County Clerk’s Office,” the order noted. “The Court is therefore satisfied that the clerk’s office is fulfilling its obligation to issue marriage licenses to all legally eligible couples.”

Bunning’s order stipulates that Davis is not to interfere with the issuing of licenses or she will be re-jailed.

        IMO, I sincerely doubt that the “protest” at Bunning’s house had anything to do with it. The Judge must have planned all along for this. If anyone else had tried to “interfere” with the office while Kimmy D was being “held”, it might be a different story. I think he wanted enough time to go by to make sure the office was working normally again.

        I find myself in the rare position of disagreeing with you on this. I was with the plaintiffs concerning her not going to jail, but then it became obvious that fining the bitch wouldn’t be any punishment at all. She got shut up long enough for 5 of her 6 clerks to say they’d issue licenses to all qualified applicants. The judge said he’d check to make sure things were kosher in the county clerk’s office and today the first report came in. It was to his satisfaction and also he was satisfied that the deputy clerks would continue to do their jobs. As it has been all along, it’s now up to Miss Kim whether she stays out of jail or not. I think this has been well thought-out and I don’t think the judge caved. We disagree, but I think the judge is on top of it.

            Kentucky is an at will state which means employees can be fired or replaced w/no reason given UNLESS it’s in their contract that certain disciplinary steps must be followed. Although her deputies technically work for and are paid for by county dollars, she is still their immediate supervisor and can hire/fire anyone she chooses. (Like her mother hired her as a deputy and she hired her son as a deputy.). Yes the judge may take it as her interfering with his order, BUT her goal will again be accomplished as it sets back issuing marriage licences while things are sorted out. After all since her and her son will be the only ones at that point working in the office they won’t have time to do everything, unless of course god comes down to help her out….

            I know that is how it works in private industry, but having worked in civil service for years, I can’t see that their employer, the county government, would allow the firing of taxpayer paid employees, in any kind of off-handed manner, especially when they are now doing their jobs as ordered by a judge. It doesn’t make any sense that she would be able to just walk in the office and tell any number of them that they are fired, pack up, get out, and don’t come back. Governments have set rules and procedures for dealing with management/employee relations. Working for government agencies generally insures some sort of job security and wouldn’t allow a pissed off little dictator of a boss to wipe out her own office and then the county would have the burden of suddenly replacing a whole office of experienced employees. Doesn’t make any kind of sense from the government’s view. One clerk has already stated that he will issue licenses even if she orders him to stop. He must know that he can’t just lose his job because she chooses to defy the court.

            I don’t know how working in an “at will” state relates to government employees and whether or not they are contracted and/or if they are exempt from the “at will” labor laws. Yes, I do know that most jobs there are disciplinary procedures in place that “must” be followed but in many cases they are no better than the paper they are written on. Again, since I am from NJ the laws here are much different. Thank you though for you input and letting me see things in a different light. Tomorrow morning should be very interesting to say the least!

            Like it or not, there are well established statutes protecting employees from having to violate their religious consciences in order to keep their jobs. You can make a pretty strong argument under both the Federal and KY RFRA statutes that she is entitled to a reasonable accommodation to alleviate her stated religious objection if it can be done without unduly burdening her employer. There are several factors a court would have to weigh, but it could well end up ordering her name to be stricken from the forms.

            Yes, and her employer in this case are the citizens of Rowen County, all of whom she must serve with equal dignity and respect. She was offered a reasonable accommodation, allow her deputy clerks to issue the licenses, but that wasn’t good enough for her, because her objections aren’t religious, she’s simply an anti-gay bigot. The Commonwealth of Kentucky is not obligated to change their laws and procedures to accommodate her animus toward same-sex couples.

            Time (and the courts) will tell. I suspect she gets her name taken off the license forms and deputy clerks issue valid licenses to gay and straight couples alike. But I’ve been wrong before. Maybe she leaves the clerk’s office and becomes a full-time posterbigot for Tony Perkins or Huckabee.

            There is no possible accommodation with her. She has stated that she thinks that by issuing marriage licenses to same-sex couples, she is dooming herself to go to hell. (As if “God” were going to be influenced, one way or the other on whether to send her to hell, by whether her name is on the licenses issued at her office). She and her attorneys are not interested in accommodation. Or to put it another way, based on her past statements about the matter, logically if one “accommodation” is made for her, she’ll find some other reason to prevent the licenses from being issued. I may be wrong, but I would be very surprised if she ever accepted any accommodation that resulted in her office issuing marriage licenses.             Well, I think if she re-defies the court order, she will end up back in jail. And this time, the judge will be far less inclined to believe that she won’t interfere, and will have looked cautious and reasonable in his actions. Her stance is already unpopular with 3/4’s of the country according to a Rasmussen poll, and it won’t improve if she remains defiant in the face of another court order.

            A person held on contempt charges can be held or released at the judge’s discretion. His releasing her is well within his legal purview. He could have tossed her right back into her cell just for stating her continuing defiance, but, I suspect he was being generous to help diffuse the nonsense. If she allows a same sex marriage license to be issued, her strong Xtian supporters will abandon her. If she denies the license, after the judge took the initiative to release her from prison, she’s going to lose all of the support she now has outside of that narrow evangelical band of crazies. Either way, the judge has tee’d her up to be more marginalized and isolated.

            The point is, she wasn’t. Her office was issuing the required licenses, and she was not there interfering. If she maintains that, she’s free pending the resolution of her original case. If she interferes again, she’s back in contempt.

            He’s appropriately keeping the focus on whether the office is doing its job and the citizens are having their rights without interference.

            Had she let the deputies issue the licenses in the first place, the entire case would never have been in court.

      Not really a cave Joe. The laws regarding contempt of court citations say that the punishment only be strong enough to coerce the defendant into obeying the judges ruling.

      He ruled that because of crowdfunding fines against her would be ineffective so he jailed her.

      He told the other clerks issue the licenses or go to jail. Five said they would obey.

      He said he would revisit the case today after a status report from the lawyers for the other clerks saying if they had or had not complied.

      The report shows they have complied.

      Bunning released her on condition she not interfere with the issuing of those licenses.

      Under the rules of contempt proceedings he is exactly right. If she does not interfere she has been coerced into obeying, which is the objective of a contempt order, and will remain free. If she interferes she goes back to jail on yet another contempt order.

      Bunning has, as many have stated, given her enough rope to hang herself while avoiding entering the grey area where she can truly claim she is being victimized by the court.For

      I understand your frustration, but civil and criminal cases aren’t the same, and shouldn’t be held to the same standards. When I filed payroll tax for our company, errors with the filings could have resulted in seizure of personal assets and even arrest in some states. Those extreme remedies don’t happen that often, but if someone stays willfully non-compliant for long enough, it’s on the table. It’s not quite the same as a murder conviction.

      • A deal had to be made, most likely shouldn’t block her office from issuing license. The contempt order had to be lifted. The easiest way to get it lifted if she agreed to some sort of compliance. If she refused, she would still be in jail, and if she continues to defy the order, she will be thrown back in jail..

          No deal has to be made. This is entirely at the judge’s discretion, since it is jailtime for civil contempt, not a criminal case. The purpose of imprisoning her was to get the office issuing licenses, and since that’s (for now) been achieved, he decided there was no reason to still hold her. He may have been wrong, but it was at his discretion. As we can see from reports, no such deal was made.

    The judge reached his determination after receiving a status report from the plaintiffs in the case — same-sex couples who sued Davis after being refused marriage licenses following the Supreme Court’s June ruling legalizing same-sex marriage nationwide.

    “The Court is therefore satisfied that the Rowan County Clerk’s Office is fulfilling its obligation to issue marriage licenses to all legally eligible couples,” the judge’s order read, “consistent with the U.S. Supreme Court’s holding in Obergefell and this Court’s August 12, 2015 Order.”

    Bunning’s order made clear that Davis must “not interfere in any way, directly or indirectly, with the efforts of her deputy clerks to issue marriage licenses to all legally eligible couples,” and that any such interference would result in “appropriate sanctions.”

    The judge also ordered the deputy clerks who are issuing marriage licenses in the place of Davis to file status reports with the court every two weeks so as to ensure compliance with the court’s order.

      Does anyone know if all of the couples has been married? After the marriage is performed, the second half of the license has to be filled in by the person who performed the marriage and signed by the witnesses. The form must be returned to the clerk’s office to be officially recorded.

      When this is accomplished, we will know that the license has been issued, the marriage performed, and the marriage legally recorded and she has not interfered.

The republican control house and senate will either do nothing or will pass a law that allows her to circumvent the judge or SCOTUS decision.           • In March 1981 the federal judge here in Dallas (Judge “Barefoot” Sanders) took over supervision of the desegregation of Dallas Independent School District and the DISD was under his supervision for the next 22 YEARS before he declared the DISD integrated, and lifted the desegregation order. The reporting in Rowan County could end up being a long-term part of the deputy clerks’ jobs.

The judge is releasing her on the condition that she not interfere, but if she says: “I will interfere” she won’t be released, so has she said to the judge that she will comply with the ruling? If that is the case, then I think Davis has caved much more so than the judge. I feel like details are scant and the ramifications of these details is enormous.

          Unfortunately, the federal courts aren’t interested in forcing every individual to not discriminate at their government jobs. They only want to be sure that any opt-outs (“religious freedom accommodations”) don’t affect the public at large in terms of their ability to seek licenses, and gay couples in particular. So if a couple can walk into the Rowan County clerk’s office and get a marriage license without any unreasonable burden such as a long wait time, then it’s satisfactory. We’re probably not going to get anything better than that.

    As such, there is no reason to keep her in jail unless she has made it clear she will defy the judge’s orders again, in which case she be back behind bars in short order.

    Until she went to jail and even after, Davis made it pretty clear that she was not interested in any “accommodation.” It will be interesting to see whether she returns, orders the staff to stop, and is thrown back in the hoosgow. It will also be interesting to see whether this takes some of the wind out of the sails of her supporters. She effectively stopped the issuance of any marriage licenses from her office and apparently is requesting the “simple accommodation” that her name be removed from issued licenses. It does not seem to have occurred to her that putting her name to official state documents is basically all that the County Clerk does, and what they are paid for. If they don’t need her name as County Clerk, whose name do they use, and, more to the point, why do they even need her? She may be arguing herself out of a job. Also, I suspect in Kentucky her staff are not unionized, but don’t they have some protections against the hostile work environment she is creating for them?

    Did he release her because most likely any gay couples have already got their license – and in such there may well not be any others going to that hell hole for a license – so the end result is that it looks like they are in compliance because there aren’t any licenses to be issued…..

            She doesn’t even sign. The form has a space that the software pre-fills with her printed name (as well as the printed name of the deputy clerk who’s actually handling the paperwork). The person handling the paperwork (not necessarily the clerk herself–it could be the deputy) initials–not signs–in ink next to their name.

            Since the deputies have been issuing licenses since Friday without her name pre-printed in that space (it just has the name of the office), it appears to be easy enough to update the software to keep her name off the forms permanently.

            While the form without her name on it may technically not be in compliance with the relevant statutes, I believe there’s also a well-established notion of intent recognized in the law; i.e., since the officials were sincere in their belief that they could issue the licenses thus, they are valid. (Also, there’s a federal court order to back them up. Also, one of Kim Davis’ own marriage licenses does not have the county clerk’s name on it, and no one is going around saying that one was invalid.)

            From what I understand, Kim Davis originally asserted in court that all the marriage license forms bore her name (i.e., that the software they use in the office to print forms automatically enters her name in the spot for it), and she implied that this could not be changed (whether for statutory or technical reasons she did not say, but she didn’t offer it as an option).

            Based on the exhibits submitted by the lawyers for the 5 deputy clerks who are now processing license applications, the software can in fact be programmed to put any text in that spot, not just Kim Davis’ name. In fact, it is now outputting the forms with the text “Rowan County Clerk” in that spot.

            Presumably, even if it were the case that the software could not easily be changed, there’s this new-fangled technology called White-Out that can–like magic–correct improperly printed forms! I bet if Kim Davis had prayed hard enough and fasted long enough (yeah, right), Gawd would have revealed this miracle of modern science to her.

      One way or another, if licenses without her signature are invalid, wouldn’t that invalidate licenses issued when she was on vacation or out sick?

    Odds are she will try to scratch her name off the issued license (I believe that her name is listed automatically on all the licenses issued, as Clerk), or she will otherwise add a signing statement that the named Clerk (herself) does not approve/condone/support/validate the legitimacy of the license, or other statement that will call more into legal question the validity of the issued license…and therefore cause more legal trouble for those persons being issued these redacted licenses.

    She will claim, through her lawyers, that these actions don’t actually interfere with the issuances of these licenses, because it’s being issued after all… but even more, when questioned, these aren’t licenses *at all* anyway since the Clerk didn’t issue them as legally required for a valid license, so she can do what she wants to them and obey this Court Order.

    It’s gonna be a mess.

  • The judge has caved. The protesters outside his home must have been too much. She will go back to jail should she obstruct any gay couple from obtaining a marriage license and I suspect she will do so. Now it is up to the Legislature to terminate her. She has a criminal record and has defied the law which is sufficient reason to remove from her elected position. Pressure should be applied to the Legislature to take action when it reconvenes in January.

        You’re correct: the judge’s actions did not need solidification. The vast majority of the country – even the fast majority of the anti-gay Christian leaders – where telling Kim Davis to shut up and do her job. All this does is make the judge look weak and stupid, and give Kim Davis yet another opportunity to look like a martyred figure being led away in handcuffs.

            And even if the residents of her county don’t have the good sense to get rid of her, the courts have committed (in a somewhat half-assed way) to ensure that same-sex marriages will happen in Rowan County whether Kim Davis likes it or not.   • This is thoroughly confusing: the law requires the clerk’s name be on licenses – when she was in jail, she could not be present so deputies assumed her duties – now that she is out, and back administrating her office, her name is again required and she will refuse. The only proper recourse is to remove her from office but the judge does not have the power to do. So how long will this go back and forth? Why did he release her, knowing she’s still going to violate the court order?

    • Because a civil contempt order isn’t supposed to be indefinite. He said he’d revisit the issue today, and he did. The office was up and running “properly,” so he really had no recourse.

      • Yes – but the fact that her availability means the office will not operate within the court’s order makes this her release a circular proposition. Her release means there will be no licenses issued – so we jail her for contempt and deputies issue licenses – deputies issue licenses – licenses are being issued so we release her – Rinse and Repeat.

        • Doesn’t Rowan County have a court case brewing against Kim-a-lot? If the court finds that she is derelict in her duties, isn’t that grounds for removal?

          • The county attorney has referred a potential criminal complaint to the state attorney – as the county was involved in the civil injunction whey could not investigate or prosecute due to conflict of interest. Theoretically, a criminal charge would allow her to be removed from office.

        • It at least shows that the judge is *trying* to operate within the bounds set by prior laws. He’s not trying to do anything outwardly hostile: in fact, he’s giving her ample chance to do things properly.

          That’s about as much as we can hope for, in this early game. Like I said: this is a long-game sorta deal here. That’s what she’s playing for, also. Fine, let’s engage. We’ve been fighting this for 45 years: another 3-6 months (at the max, hopefully) to put her and the rest of the scumbuckets into line? It may make the end even more solid than if we rectified this in 2 days.

      I’m not sure there have been licenses issued to straight couples, but if there were, they were issued the exact same way. The office was never differentiating between gay and straight couples when it came to halting licenses.

    I’m a little baffled here by the people who are claiming the judge didn’t cave. He put her in jail and said he would keep her there until she agreed not to interfere with her clerks issuing licenses. She said she would absolutely interfere. He lets her sit for a few days, and then lets her out, warning her that she’ll go back in if she tries to interfere…something she has already insisted she will do. How does it no make the judge look like an imbecile when Kim Davis gets to work and tells her clerks to stop issuing licenses?

    This was either an attempt to undermine the Huckabee hate fest (which, great job: you just gave them their poster child to put up on stage with them) or he’s trying to get those damn Christians off his lawn. Either way, it’s fucking stupid, and it’s fucking bullshit, and it’s fucking caving.

    Here’s how Kim Davis gets out of jail in a just world: She resigns, or she agrees to issue marriage licenses to all qualified applicants. Period.

      This was about having the county office issue the licenses and not a specific person, that’s why Kim’s personal religious beliefs don’t matter. Since the county office is now issuing licenses, the judge did the right thing — with the stipulation that she not order the clerks to stop. If she does that, then she is in violation. This also prevents her from being a martyr, but she’ll try.

        The judge already offered to let her out if she wouldn’t interfere. She said she absolutely would interfere, so he kept her in there. Now he’s letting her out, even though she hasn’t changed her position one iota.

          Something I thought we were big on. He had already said, on Thursday, that she was gonna get looked at on Tuesday. He did, and she was.

          Not really. It’s a legal process that doesn’t allow for what a judge presumes she will do if released. If she defies him again, and we presume she will, then, yes, we go again, but the punishment will be that much harsher and she’s already laying the blocks for future defeats of any appeals.

      The judge’s goal here is to get licenses started again in Rowan County. Once that was achieved, it’s at his discretion to see if releasing Davis would fuck that up again. It probably will, but he can’t necessarily assume that. Her statements have come after he ordered her released. Plus, it looks very bad for her if she continues to defy the judge after a second order. She’ll be back behind bars in no time if she does so.

            Regardless of the Huckabee show, nobody sane was clamoring for Kim Davis to be released. Across the country, she was viewed as a rightful prisoner of her own stupid, religious bigotry. She didn’t even have firm support from Krazy Khrisitian Land. And now we’re supposed to be afraid that people think she’s being persecuted unfairly?

            Bullshit. This is ludicrous, cowardly, and stupid.

            You are overreacting. She’s not going anywhere. She’s not a flight risk. He didn’t let her off the hook, he’s just releasing her from an indeterminate jail stay to see what she’ll do. Any time you or anyone else calls Judge Bunning a coward for this, you are feeding the right-wing frenzy that’s proclaiming “we’ve won!” and telling themselves that picketing at a federal judge’s house gets results. Yes, you are becoming part of the problem if you do that.

I’m just worried that they, or she, might decide to go to the courthouse and shut it down, do an Orval Faubus. At that point, the Federal marshals have to collect her and it could get ugly.

    If it comes to that, if the marshals and the Commonwealth can’t do the job, the 101st Airborne Division is stationed at Ft. Campbell, KY. They intervened in 1957 in Little Rock, and …

      It has been demonstrated she may NOT violate her oath to the Constitution with impunity. Government officials may NOT violate the Establishment Clause and impose a religious test on citizens exercising their constitutional rights.

      AND a handful of couples have FINALLY been issued the marriage licenses they have a fundamental constitutional RIGHT to.

    It’s like with her son–HE refused to obey the judge, but wasn’t jailed, at all, in HIS case, as long as the other clerks obeyed the order.

    She’s out, for now, but if she seeks to interfere and stop her deputies from obeying the law, if she yet AGAIN violates citizens’ civil rights, it’s BACK TO JAIL (or other “possible sanctions,” whatever THEY might be. Who knows what Bunning may have up his sleeve? He has already said he knows her supporters would pay any fines).

    I have the feeling that Judge Bunning knows exactly what Kim is going to do, and he actually expects to send her back to the pokey.

    Bunning set up a compromise
    He allowed Kim’s son to refuse (presumably on religious grounds)
    Releasing Kim diffuses the mounting tension from the Xtianists descending on the county
    Bunning probably expects Kim to disrupt the compromise.
    He’ll send her back to the slammer, and it will be even harder for her supporters to claim she’s being persecuted when she is found forcing the other clerks to stop issuing marriage licenses.

    (Disclaimer – I have no actual inside knowledge; this is just my hyperactive imagination speaking.)

    I’m guessing Davis will immediately order ‘her’ clerks to cease giving out SSM licenses first thing in the morning. Then, she will declare that all licenses which were issued to SSM couples are null and void and refuse to register them after the ceremonies.
    Oh, and whoever the PC-Police around here are, you’re no better than Davis is.
