If the First Amendment needs a Defense Act in order to be fully binding, doesn’t it imply that the Constitution cannot stand on its own as the nation’s foundational document? Doesn’t it seem like a effort to weaken the status of the Constitution? Going forward, will all provisions of the Constitution need Defense Acts to make them fully binding? If the Religious Right got their Marriage Amendment, would a Defense Act be required to seal the deal, or would that be an exception?

    The way I see it is that the Constitution lays out the general outline of protections, prohibitions, restrictions on government, enumeration of rights, etc. The laws spell out the details. “Freedom Of Speech” for example – this Constitutional guarantee makes it seem that you can say, shout, scream anything you want about any thing or person any time you want. Not so. The specific “freedom” has to be defined by law so as to prevent any infringement on the other person’s rights or harm to society. It’s the old “you aren’t allowed to just yell FIRE in a crowded theater just because you have free speech”. Plus, with changing times and advancements in technology, many new forms of speech have been added and protected by new laws defining them. Flag burning, for example, was determined to be a form of speech and thereby protected under the First Amendment. Just so long as that fire doesn’t break any local fire/burn codes or present a danger to the community.
    These prickly Christians want to define and expand on the guarantee of “religious freedom” protected by the First Amendment. Look at that c.nt in Kentucky who refuses to issue marriage licenses to gay couples. She is claiming an infringement on her constitutionally protected religious rights. The Constitution doesn’t say anything about marriage or licenses or your job requirements. The law spells that out and they want to expand on the “freedom” of religion to create an exemption to the law that now defines gay marital equality.
