TEXAS: Hood County Clerk Caves, Issues Marriage License To Gay Couple, Couple Won’t Drop Their Lawsuit

Bloomberg reports:

A gay couple that sued a rural Texas county clerk over a delay in the issuing of a marriage license received the certificate just hours after filing the complaint. Jim Cato and Joe Stapleton say they won’t drop their lawsuit though until the clerk’s office agrees to issue marriage licenses to “all couples, gay and straight, without delay.” They also want their legal fees paid by the county. Cato and Stapleton were repeatedly turned away last week by the clerk’s office in Hood County, about a half-hour southwest of the Fort Worth federal courthouse where they sued Monday. They said they were told it would take “at least three weeks,” because the county needed to have paperwork reprinted in a gender-neutral fashion.

The men said they have been “waiting over 27 years to marry” and were “humiliated” by county employees’ refusal. Katie Lang, the county clerk, had said she won’t personally issue marriage licenses to same-sex couples because it violates her religious beliefs. She said someone else in her office would do so as soon as proper forms are supplied, according to a statement on the county clerk’s website. The couple’s lawyer said he provided the clerk with copies of corrected state marriage-license applications from the state’s website. They were told a different form was still needed, according to the complaint.

Today’s marriage license was hand-written.

    About the only thing I could see waiting for would be appropriate paperwork. Being an opposite-sex marriage was easy, but if I were in an SSM, I wouldn’t want one of us to be listed under “wife” if we were both male. It should just be “person” or “partner” or “spouse”, etc. And you know damn well places like Texas weren’t going to do shit in advance of the ruling to make sure compliant documentation was ready.

    As for the clerk, fuck her, and I hope she gets fired.

        They might get legal fees, but I seriously doubt a judge will award emotional damage. It’s rarely awarded anyway, and I just don’t have faith a court would see this as rising to the level of monetary damages.

      The couple were clearly hurt when they were interviewed after they were kicked out of the clerks office. They were shocked at how they were treated, so that video alone can be used in any civil proceedings. It was so great to see them stand up for their rights.

    According to mashable, there are only 13 counties currently not compliant in Texas. Only one of these clerks, Haydee Torres of Kimble County, has expressed that is due to religious beliefs. I haven’t heard any updates on her.

I really want to marry you right now but I can’t because I don’t have the proper updated forms”. It’s always the homophobes who are sticklers for “proper forms”; unless of course it’s a gun license that’s not updated. Then everything’s hunky dory!

    In fact, in Tampa, my marriage license application AND marriage license list my husband as “wife”. We fought over who would be the “wife”. HE won!

I do not know), but one of the things I found amusing when living in Texas during the 80s was the neo-modern California-like open shopping mall/golf course/communities that popped up all over the hill country. Of course, all the architecture paid homage to the Alamo by having faux Spanish colonial tops or facades — and, of course, decorating everything with as many five-pointed stars as possible. As with most of the USA, Texas was a lot more interesting before the building boom of the 80s. 🙂

    When they came in last week there was a reporter filming. The two guys ask for a marriage license and the women got Katie Lang to come out. When she did the first things she tells them is to get out of here and kicked them out of there. Then apparently she called the sheriff’s office on them as well. All that just because they asked for a piece of paper.

    I don’t think they should drop their lawsuit because obviously that office with Katie Lang in charge would do it to the next gay couple that shows up.

    The story is that it’s an elected position and Katie Lang ran on the Tea Party. Also her husband is running for state office which is probably why she was so belligerent.

    Someone posted the video of the local news coverage when those two men were refused a license and then kicked out of the clerks office. I honestly think what turned the tide was the TV cameras and the nastiness and near violence from the protesters who were supporting her. The couple applying for the license are two big strong Texans if I’ve ever seen any and it probably shocked her that that was the first couple to ask for a license. lol She looked hella scared of them and the TV cameras.

    Well another obstructionist bites the dust and hopefully she will have to come out of pocket in payment for her bigotry. I’m so proud of Jim and Joe and the courage and fortitude they displayed in being dogged about their rights. I know there are young LGBT’s out there in Texas who got just that little bit more of courage by seeing such fine examples in those men. I hope we get pictures of the nuptials, I bet they’ll be brilliant.

        I’m not surprised by that. In the video I saw a few confederate flags and a man who almost hit a woman he was arguing with, she was in support of Marriage Equality and he wasn’t, big surprise there. I think the clerk got spooked a bit at the thought of this whole thing escalating to violence. She cared about the issue to a point, but when she had to face real flesh and blood people and see real consequences to her actions she caved. The bigots may be passionate about this issue but I don’t think many are passionate enough to shed blood or sweat, they only seem to have the energy for tears and none of us mind the tears. lol

  • The State of Texas posted the correct forms on the internet within a day of the ruling. Over 200 counties somehow managed to issue licenses. I guess lying isn’t a sin in her church.

      What is posted on the internet is the gender-neutral application. I believe what they are referring to is the printed marriage license certificate. Some of the Counties are dragging their feet having the changes made in the computer so they have a weak excuse for continuing to be assholes. Lubbock County tried this until they were threatened with a lawsuit too. Decent people have just been marking out and replacing on the printed certificate.

    I knew they’d do everything in their power to make it difficult on us, so none of this surprises me.

    The clerks office in my County of residence, closed the doors altogether the afternoon of the decision. They’re open now, but they’re not marrying couples at that office, and we can find no one in our county who will officiate. Since they’ve made it so much of a hassle we decided to go to another county to get our license and to be married. We applied for our license this morning online. From what I understand this is happening all over the South, but as long as we persevere, they will, in time, realize that they have to hire clerks who will license and marry same sex couples. Forcing tax paying citizens to go to another county to get married is just as much of a burden on straight couples who only want a civil ceremony as it is on gay couples and it won’t take long for them to realize that.

        We’re not married yet, we just applied for our License online this morning. Our plan is to get married next week while my partner is on vacation. Finding someone to marry us (officiate) has been a challenge, but I think I have it all worked out now. Hopefully, by the end of next week we’ll be married, and we only had to wait 31 years. 🙂

        We live in TN, about 40 miles south of Nashville. We’ve decided to go to Nashville, which is in Davidson County, to get our license and to get married. We could get a license in our County, but we haven’t been able to find anyone to marry us here. In Nashville, there are Judges and Council members that are performing same-sex weddings, but there’s a bit of a waiting list. The Clerks office in Nashville is also performing same-sex weddings but you have to be a resident of the County. Unfortunately many of the surrounding counties, like mine, are issuing marriage licenses, but their Clerks offices are not performing marriages.

      Judge Gary Tabor in Washington State tried the same thing when marriage equality was made legal by the vote of the citizens.

      The Washington State Judicial Conduct Commission “admonished” the judge.

      Again with you and being an apologist on this type of issue. First of all she wasn’t allowing anyone to issue the license and she made the couple wait for over a week and even called the sheriff on them after she kicked them out of the office. I’d say that’s a pretty big deal. It wasn’t a matter of waiting for the right forms, the license they got was the same license they suggested as a fix days earlier. So it was just a stall tactic. If she had did as you posted there wouldn’t have been a problem in the first place. Do you really think that all gays are so damned petty that they wouldn’t be fine with her delegating the job to one of the staff in the office? These two men just wanted to get married there and then, instead they got humiliated and had law enforcement called on them when they did nothing wrong except try to exercise their rights to marriage.
