LOUSIANA: Bobby Jindal Blocks State Recognition Of Same-Sex Marriage

SCOTUS has ruled, the Fifth Circuit has ruled, but Bobby Jindal just doesn’t care.

Gov. Bobby Jindal delayed — for the second time — the recognition of same-sex marriage by the Louisiana state government on Wednesday evening. The governor refused to let Louisiana agencies acknowledge same-sex marriage following a U.S. Supreme Court ruling last Friday. At the time, he said he was waiting for a lower appeals court to affirm the U.S. Supreme Court’s decision, before moving forward with same-sex marriage recognition in Louisiana. But now that the lower appeals court confirmed Louisiana’s same-sex marriage ban has been overturned, Jindal has decided Louisiana same-sex couples need to wait for yet another court’s decision. “Our agencies will follow the Louisiana Constitution until the District Court orders us otherwise,” said Mike Reed, Jindal’s spokesman in the governor’s office.

In its opinion released Wednesday evening, the 5th U.S. Circuit Court of Appeals made it clear that Louisiana’s same-sex marriage ban no longer applies, though it technically sent a same-sex marriage case back to a U.S. District court for reversal. Jindal is saying the state government won’t recognize same-sex marriage until the District Court issues its own decision. The appeals court gave the district court until until July 17 to make a new ruling, though it has encouraged the district court to do so earlier. One of the plaintiffs in the case, Robert Welles, is in declining health. “I wait every day for a phone call,” said the 52-year-old Welles. “The way I see it, we started this thing in New Orleans, and we want to finish it in New Orleans.” But Kyle Duncan, a lawyer working for Louisiana and the Jindal administration, said it makes sense for state agencies to wait to recognize same-sex marriage until the district court ruling. “The court made it crystal clear,” he said. “It’s when the district court renders final judgment.”

You’d almost think that Jindal is hoping that the plaintiff will die before his marriage is recognized.

    Isn’t this litigious reverse order? the Supreme Court, the 5th circuit? These are dispositive rulings for lower courts. They’ve ruled, that’s all you need to know. The next step is going to be handcuffs for Jindal

      Technically, they didn’t rule on the specific case at hand. They stated the precedent that must be followed. The Fifth Circuit cases were not specifically before the Supreme Court. The Fifth Circuit directed the lower court to rule in accordance with the precedent. Other courts will also be required to base future rulings on the same precedents. Purely technically, this isn’t in any way incorrect.

      But it is supremely petty on Jindal’s part.

      There is no question what the ruling will be, and Jindal knows it.

    Louisiana is a third world country. The infant mortality rate is almost exactly the same as Botswana. 11% of infants suffer from low birth weight. Roads are worse than most middle-income developing countries. Buildings are decayed. The HDI is by far the lowest in the US, and on a par with, say, Belarus. It is also an extremely dangerous place to live; the murder rate is higher than, say, Haiti’s.

    Is it a wonder, then, that their attitudes are also slightly backward?

      The 25-day reconsideration period only applies to the losing parties in the case–that is, the states of Michigan, Ohio, Kentucky and Tennessee–all of whom have already said they would comply with the decision.

      So that issue is moot. In the 5th Circuit, the court of appeals has ruled that the cases before it have now been decided in favor of marriage equality. That affected cases from Texas and Mississippi.

      The case in Louisiana had been decided (at the District court level) against marriage equality, and was on appeal to the 5th Circuit but had not been taken up by that court yet. The 5th Circuit’s recent order requires the District Court in Louisiana to reissue its ruling in light of Obergefell. Jindal is shamefully standing on the letter of the law and requiring state agencies to wait for the amended ruling from the District Court, even though the outcome of that ruling is a foregone conclusion. Per the 5th Circuit’s ruling, the District Court has until July 17 to issue its amended order.

        Thanks for the clarification. So, actually Jindal is an even bigger asshole than I thought, and I didn’t have a very high opinion of him to begin with. I keep reflecting back to that video of him with his kids and thinking that some day they will have to live down his reputation.
