      Unfortunately, in terms of a Wikipedia map, we are still a *long* way until seeing that all all blue. As has been pointed out elsewhere, we lost in Louisiana and the 5th Circuit had it under consideration. It is *entirely* possible that it could be 3 months (or more) before Jindal and the Louisiana State government (probably at the point of having to be arrrested) get to the point where you really can walk into any parish and get a marriage license and until then, it won’t be blue on Wikipedia. 🙁 🙁 🙁

      You should see me, I am F this and F that, just letting the years of frustration OUT.

      I have been following Gay Rights since January 2010. I know that is young compared to most of you, but for me it has been an intense 5 years. I did some work. My work was presented to the Supreme Court. I never tell anything specific that I do as there are haters all over the internet and I don’t want to be a target, just know this, I HELPED I REALLY DID!

          Roger, you would literally shit if you knew what I moved and how I did it.
          And not just one issue either, I have been working anonymously behind the screens and I have been effective. As a matter of fact Mary Bonauto quoted me practically verbatim to the Court during oral arguments and I gave her that line of reasoning. That is just one thing.

          What was the BIGGEST argument we had to fight tooth & to refute? What was it? That having gay parents is harmful to children. They tried pseudo science to back up that claim, but someone was in the weeds and took that down. I fought that on many fronts and I WON! My name is not on anything but my fingerprints are literally on everything on that issue. I beat the crap out of that attempt at pseudo science. All legally, quietly and behind the scenes. When you read carefully the majority opinion and the dissents, nobody is citing social science research to say that having gay parents is harmful to children. This very powerful argument was taken off the table. This is the last time I will write about my part in this.

          This is YOUR Victory, this is OUR Victory, but it is also MY Victory.

    We won and it’s a huge victory that we fought for us a a huge kick in the ass for the bigots and the cults. The victory is ours and ours alone and we had to wait 19 long years to overturn Bill Clintons DOMA and George Bushes state DOMAs.

    We’ve been waiting about 40 years for the passage of a clean ENDA or a CRA. It’s clear that we need a broad version of ENDA, the Employment Non-Discrimination Act, cleansed of all the garbage added on by Democrats to appease the cults.

    Even better, we need a robust federal Civil Rights Amendment covering public access, employment and housing for ourselves, people of color, women, trade unionists and immigrant and imported workers that makes it easy to sue and win and provides harsh penalties for offenders.

    We aren’t going to get either from Democrats or Republicans. We’ll have to fight for our rights and create a militant mass movement politically independent from Democrats and Republicans.

    Justice Kennedy has an out gay law clerk who was a student of Lawrence Tribe. It’s so fitting that this should occur in this historic case when it was back in Bowers that Lewis Powell swung the vote against gay rights while he had a closeted law clerk and claimed he knew no one who was gay.       I was slow to grasp how much this issue mattered. It isn’t about just a ceremony or a license. Marriage – being able to marry and being married – changes our relationship to everyone around us. Winning this opens up a new path in life for all of us, but for young LGBs most of all. Let them take it and live and thrive in a way that, in years past, we could not.

      and..as a childrens librarian, she spent her retirement years dressed as a clown, with a ridiculous wig, bringing kids books and cheap toys (there was a budget to consider) at the kids wing of the hospital with her assistant. she was…so, so happy.
      and, when she died, in that hospital, I held her, her boyfriend held her, her first husbands (dad died in 76) 4 brothers and sister were at my side,friends were there, and about 40 (!) hospital staff were there…out of respect.
      be happy now…it..makes up for it.

    Scalia actually states that the Supreme Court has no business ruling on anything that wasn’t understood at the time the Constitution or its individual amendments were written, regardless of what they actually say.

    Because marriage was understood to be between a man and a woman, the fact that the 14th Amendment addresses all citizens without respect to gender, it immaterial.

    Yet this is an asshole who has no problem issuing rulings about the Internet, automatic weapons, airplanes, or any technology that came after the writing of the constitution, nor had an issue with declaring corporations to be people with constitutional rights, when it’s manifestly clear that the founders didn’t envision Microsoft or Hobby Lobby even existing.

      Who would have standing to launch a lawsuit against marriage equality? Thought experiment: how could a gay man construct a lawsuit that would challenge the right of heterosexuals to marry?

      Kennedy seems to have cut this off by going back to constitutional basic principles on marriage.

      My guess is you’d need a constitutional amendment to turn back the clock.

    I’m going to say it. And, yes, I’m a stick in the mud pessimist.

    I’ll have to read the whole thing but based on reports, the narrowness, the timidity of this ruling is infuriating. The Five went out of their way to craft a decision to placate or appease the Four. No declaration of heightened scrutiny, reliance on the right of marriage and flowery language thereto, instead of dealing the with elephant in the room: our human equality.

    And what did it get them? Could the Four be any less outraged? Could their rebuke of their colleagues and their dissent be any more strident? No. When the Chief Justice attacks the integrity of the system in a dissent, he lights the flames of resistance.

    Ruth Baiter Ginsburg made much of her fear of a Roe-like backlash. In her caution — or perhaps in Kennedy’s unwillingness to embrace the truth — she just got her wish.

    I fear for 2016.

      I think Ginsburg would’ve authored an opinion involving heightened scrutiny. Kennedy is just too conservative, and his opinion was the only one that counted ultimately. I’m just happy he didn’t chicken out.

        The thing is, she — and others — could have authored their own concurring opinions presenting stronger arguments, not creating higher barriers (since they would lack the necessary majority) but at least expressing them, giving ammunition for the nasty fight ahead.

      Even in the absolute worst case scenario, where Santorum wins in 2016 and then Ginsburg steps down and is replaced by Justice Bryan Fischer, this ruling will be extraordinarily difficult to un-do. Any challenge probably would not reach the Court until 2018 or 2019, by which time 20 states would have had same-sex marriage pursuant to federal court decisions for 5 years and another 13 would have had it for 4 years. There would be several million Americans in same-sex marriage in these states. Very difficult to undo that, even more so than it would to un-do Roe v. Wade or Miranda v. Arizona.

        You make a good point about timing and the security of marriages, existing and future.

        On the other hand, the Fischer Court (cuz you know Santorum would push Roberts aside and hand the reigns to the junior justice, just like Bush did), would be there to judge Equal Protection for everything but marriage.

        Straining to look at this more positively, at least this way the new generation of gay whippersnappers will have plenty to work on, so they’re more likely to stay off my lawn.

A Black lesbian from Texas and an older Latina lesbian, married in Canada 6 years ago, living today in Virginia, and now standing outside the Court. They are both elated and are speaking beautifully about what this means. The younger woman can barely contain her tears of happiness. I want this held up to all the bigots faces when they try to claim that they were for or weren’t vehemently apposed to Marriage Equality. Let them be the face of shame that George Wallace is today. Let them be looked at the same way the White Citizens Council and the Segregationists of the 1950’s and 60’s are looked at now.

  • My hubby and i are OVERJOYED for our dear friends back in Louisiana, Patrick & Michael, who went to D.C. on their 31st anniversary to legally marry four years ago – 35 years together as of May 2015. NOW Louisiana has to recognize their legal marriage. I’ve known these guys for 23 of those years. I just can’t describe how happy i am for them!

    Looks to me like that’s language we’ll see again, mapped onto other areas of LGBT rights. Sounds like a call to make sweeping equality a matter of fact, not a matter of the ballot box.

    I just talked to my 94-year-old mom, who’s been a supporter of marriage equality — and nondiscrimination generally — for the last 15 years or so, and she is as thrilled as everybody here. She lives in Washington so she’s had a lot of young gay friends get married already (she adopted a whole bunch of young men years ago and became their substitute grandma, to replace their real grandmothers who had never accepted them), but she appreciates just what this means for EVERYBODY. I just wanted to pass on her congratulations to everybody from a very elderly but very strong ally! 🙂

        I wish I could, but I’m 3,000 miles away. But never fear, we had a lovely celebration together on the phone! She honestly never thought this would happen in her lifetime. We ended up comparing it to her mom, who hadn’t seen an automobile until she was 19, but lived long enough to walk on the moon — the world is changing to remarkably quickly, and for the better. This is an incredible day for us all!

      I have only read about a page, but a quick scan of the document says: the opinion of the court references it a bunch of times (looks like 9 references), as does Roberts’ and Thomas’ descenting opinions and the syllabus of the opinion… which looks like some sort of summary.

    2:48 pm EST…been up in the woods at Grannies’s Field over night in the camper. Totally off grid. Climbed up the mountain to pick black cap raspberries around 7:30 at 810 in the bowl i started eating till i got to 956. They were delicious. Got back to camper for break and checked time. Twas 9:58 am. Went out to plant potatoes thinking “it’s about to happen and i’ll know when i know.” Now i know and did i have a good cry, but all through the tears was laughter! In a little under 6 months i will celebrate my 80th birthday on the winter solstice. It is fucking hard to believe i have lived to see this day. It sure as hell ain’t 1956 any more. Oh and best wishes to all you who got married today and or will in the near future…now if i can just find some one to propose to here’s a pix of the Vortex Chapel in the Woods on the land where i be the resident gardener. And that’s how it came down here in the far boonies of the Blue Ridge Mountains of western North Carolina. Blessings on all our pointy little heads.

    Louisiana has yet to issue licenses. They’re waiting for the period of time that the decision can be reversed. I’m so damn mad at my state. This is backwards southern thinking at it’s worst. This is something that shouldn’t change from state to state. All the conservative states need to pull their homoohobic panties up and learn the meaning of equality.
