Scott Lively’s Crimes Against Humanity Trial Begins, Liberty Counsel Demands More Information From Ugandan Plaintiffs

The crimes against humanity lawsuit against Scott Lively began today with his Liberty Counsel lawyers demanding more information from the plaintiffs, Sexual Minorities Uganda (SMUG). Via MassLive:

Lively is being represented by the Liberty Counsel, based in Orlando, Florida, which bills itself on its website as “an international nonprofit litigation, education, and policy organization dedicated to advancing religious freedom, the sanctity of life, and the family.” It has provided pro bono legal assistance on these and related topics since 1989. Attorney Roger Gannam on Tuesday argued that lawyers for the plaintiffs were being so surreptitious in turning over documents – already subject to an “attorney’s eyes only” restriction – that it was hindering Lively’s ability to wage an effective defense.

“Scott Lively has no desire for the information except for this lawsuit,” Gannam argued to U.S. Magistrate Judge Katherine Robertson. “SMUG has not proved that it’s reliable in deciding what Scott Lively should see and shouldn’t see.” In particular, the lawyer cited an email relating to a SMUG fund-raiser geared toward paying fees in the Lively case, which he said was so heavily redacted even the subject line was blacked out. Gannam also referred to images the plaintiffs have withheld of participants at the 2009 workshop in Uganda, which he argued Lively couldn’t confirm were there if he can’t see their faces. Gannam also suggested the plaintiffs’ representation of the significance of the 2009 workshop in Uganda was overstated.

Lively did not attend today’s hearing. According to the above-linked report, he is planning to move his ministry from Springfield to Riverside, California in order to “expand the brand.”

RELATED:  On May 11th SMUG issued a subpoena which demands that notoriously anti-gay Ugandan Pastor Martin “Eat Da Poo Poo” Ssempa appear to testify at the trial. The subpoena included a $1900 check to cover Ssempa’s travel costs from Uganda. Normally a prolific many-times-per-day Twitter user, Ssempa has not tweeted since the subpoena was issued.

    The only thing Scott Lively should see are the four walls of a prison cell. Unfortunately, he won’t, because the Alien Tort Statute (resulting in a civil trial) is the only available legal recourse to punish him, as far as I know, for crimes against humanity committed in other countries.

    I do hope that his finances end up as bankrupt as his morals, as I said to Octavio already.

      Loretta Lynch has successfuly charged international non-American criminals who haven’t even committed a crime in the US in the FIFA scandal. If any of Lively’s African cronies can be shown to be financially corrupt (probably not difficult), he’s fair game for jail time.

      Western Massachusetts is full of liberals and, when he ran for Governor in MA, he got about 12 votes. There’s probably more latitude for his particular brand of hatred in CA’s Inland Empire than there ever was or ever will be in Massachusetts.

      I’d like to see him on National TV, and have him confronted with all the blood he has on his hands, showing photos of all who have died for his viciousness and have him try to justify it or finally admit that he’s a murderer by proxy and should be imprisoned. Then, every time he tries to obfuscate, lie or dodge the questions, he gets zapped with a taser (finally, a legitimate use for them). That still wouldn’t come close to making up for his crimes, but it’d be a great warning to others of his kind, and probably be a great help in showing the moral bankruptcy he adheres to. He might as well serve a purpose in this world somehow, at last.

At the April 28th marriage equality hearing, that piece of shit was standing behind Tony Perkins and Sandy Rios on the SCOTUS steps rubbing his hands and licking his chops. His sister is a lesbian, and dammit-to-hell, we’re ALL going to pay. If any of you haven’t seen him in action and the crazy beyond-slanderous way he has lied about gay people to ignorant gullible people, be sure to check out ‘God Loves Uganda’. Just be sure to keep rocks, beer bottles, small pets, and other throwable items far from your tv screen. You’ll thank me later.

    All that must be done is for prosecutors to have HIS OWN writings and speeches admitted into evidence. Lively, and those like him, are *notorious* for recording and documenting their own criminality. His own words and actions are enough to demonstrate overwhelming intent to harm LGBT at home and abroad, and he will have no one else to blame but himself when he’s found guilty and sentenced for it, hopefully for the rest of his life.

  • Just so no one is confused, this isn’t the beginning of a trial. Today was a motions hearing to consider certain motions having to do with discovery. I haven’t had a chance to read or post all the motions yet. At present, my days and energy are being taken up with the JONAH during the week. Will try to catch up with this over the weekend, but didn’t want anyone to be confused about what is happening here.

    For some context, here are upcoming deadlines in the Lively case:
    – Lively’s motion for summary judgment, if any, is due June 30; Plaintiffs’ opposition is due July 1, and any reply is due August 11.
    – A hearing on any motions for summary judgment is scheduled for September 10, 2015, at 2:00 p.m.

    As far as I know, no trial date — if this goes to trial — has been set yet. (I’m saying that from memory – would have to check the docket to be sure).
